Gotta love Tarik Fabiani. The CC owner had best hope security tapes
from her establishment back up her version of events. Aiding in covering
up witness tampering is a felony.

So let me get this straight. The generally-agreed-upon facts in this
case, the sort of things that would lead to a guilty verdict, are so
weak that *this*, once more, a bunch of he-said she-said stuff, is a
"game changer?"

Everyone knows that Aspen is "Lance's" town. Especially Tyler. And the
folk from Outside Magazine. This sounds more like a sad attempt on
Tyler's part of try and put down Lance on his (Lance's) turf, or maybe
provoke a reaction that Novitsky's fanboys would drool over. Tyler ain't
man enough to pull that off. Lance may be arrogant enough to be pulled
into it though.

Aiding in a "cover up", how? That's a mighty, mighty reach even for
you.

Unwanted touching, by Hamilton? That's assault, by some definitions.

From the Clinic Forum. Comments in [ ] are my additions, Fanboys:

A couple of things for you to ponder.
1. Outside Mag contracted services from Hamilton to be performed in
Aspen. That might explain why all the Outside reporters/bloggers were in
the restaurant as well as Hamilton.
2. There are indications that it was not a chance meeting from
Armstrong's point of view. He was in Tennessee that morning from a
number of reports noted here and flew to Aspen during the day. The FBI
can easily check to see when the flight plan for his jet was filed and
if it changed a prior flight plan on file with the FAA. [it is easy
enough for the Feds to obtain records of texts to and from Armstrong and
friends that day]
3. CC is a public place of business that was open to both Hamilton and
Armstrong on Saturday evening. If Armstrong touched Hamilton and impeded
his movement, that could be interpreted as a form of intimidation. In
some jurisdictions, like Massachusetts, mere unwanted touching by
another is assault--no common law or statutory battery needed. [there's
no such thing as Aspen being "Lance's town." Lance is responsible for
his action there just like anywhere.]
4. If Armstrong stated to Hamilton what Hamilton reported to his
attorney, Armstrong made clear reference to possible impending Hamilton
trial testimony and made remarks relative thereto of an intimidating
nature.
5. Lance's friend Jodi the CC part owner would do well to consult
counsel before she says another word lest she be seen as participating
in/abetting witness intimidation. If nothing really happened, why would
she make a point of telling Hamilton to never return when Armstrong was
present in CC at the same time?

Your boy Lance is one stupid bully from Plano, Tarik. A guy who doesn't
fear the truth has no need to intimidate others telling the truth.

Lying about what was or was not said to rebut the claims of another
adverse to her good customer Lance, is participation in the intimidation
after the fact thereby trying to conceal the illegal act. Welcome to
the real world, Lance, et al.

You really think LA flew home early just so he could confront TH
outside the restroom of a public restaurant??? Damn.

If he really wanted to intimidate TH, even a bully from Plano knows
you send someone else to do it.

Fact--Armstrong was in Tennessee Saturday morning. Did he fly back
specifically to confront Hamilton that evening? Possibly. It's fairly
easy to determine with the investigative power of the Fed. government.
Maybe the bully from Plano is having trouble finding people to do
certain deeds these days. Or, maybe he just lost it when he say
Hamilton. Either way, he fucked himself royally.

I don't really want to fuel the fire, but there was a very Lafferty-
esqe post from someone with the handle "HJR" that has a similar verbal
threat. The "harming his ability to make a living by threatening his
position in the break" is a hoot though.
- - - - - - -
HJR

It's my understanding that Simeoni claims (don't know if there are any
willing witnesses) that Lance threatened him professionally and
economically when he caught up to the break. That's witness tampering
whether it is in a sporting event or a darkened parking lot or in a
hotel room. If you threaten a witness of a court case you are
intending to influence their testimony, hence tampering with that
witness.

In addition to harming his ability to make a living by threatening his
position in the break, this quote is from an MSNBC article:

"Simeoni was quoted by Gazzetta as saying that while he rode with
Armstrong, the Texan said, “You made a mistake to speak against
Ferrari, and you made a mistake to take legal action against me. I
have money and time and lots of lawyers. I can destroy you.”"

Um, the case could be easily made that "they were all lying". Some
people call it a point of view, but this, by report, goes beyond.
The "quotes" are so incredibly far apart as to substance, etc. that
unless there is a pretty clear sound track, and a clear "vid" of the
alleged confrontation, who can "prove" what?

This event smacks of a set-up by the Outside crew; it wouldn't be too
difficult to find out where someone famous hangs out in such a small
town, which is full of celebrities and fawning gawkers. Soooo...
unbeknownst to Tyler (possible, and he was said to be "surprised" by
Lance's appearance), even, the situation was arranged by Outside, and
it's grist for the paper-selling mill. So has Outside joined the witch
hunt, too? I don't read that one so I'm not familiar with the recent
editorial output.

If it was a setup, I wonder how Tyler feels about his buds at Outside
pranking him like that? Welcome to the real world, Tyler (he said
sarcastically in response to BL).

The bit about Lance flying into Aspen just to confront Tyler might be
true but on the other hand, it's been 100+ degrees pretty much daily
for some time in Austin, with no rain, and there is a long tradition
of Texans spending as much of the summer as possible in western slope,
Colorado. And Aspen's airport is about as handy as you can get. My
money is more on the Outside crew, with or without Tyler's knowledge
or complicity.

Mike - my family has been in Aspen since 1972 and it isn't anyone's
town. Fuck I don't even like going there for all the bullshit the
place is now. (and we have acreage! ) Long live Spider!

I am of the opinion that Lance sought Tyler out in this case.

WTF, I visited Aspen and the sidewalks were not
painted yellow, although there was a yellow stripe
down the center of the street, maybe that was Lance's
street? Maybe they only paint the sidewalks in summer.

Both of these guys are, in case no one has figured it
out, morons. It isn't "Lance's town" even if he's rich enough
to have bought a house and hang out there. At least
Tyler skis or used to, but wtf was he expecting, the
moment he saw Lance much less made eye contact
or voice contact, he should have excused himself rather
than trying to hug it off.

The idea that either of these clowns deliberately set this
up is ... conspiracy talk. I really doubt Tyler wanted to
set Lance up. More likely, Tyler wants to be loved and
accepted, and Lance wants to kick his ass, but knows
that's not acceptable in a chi-chi restaurant. Oh, such
drama. They should junk the trial and put Novitsky,
Tyler and Lance in a reality TV show. The proceeds
could go to the FDA to fund E. coli inspections.

BTW, I've never eaten at this place, but have a feeling
that if you're eating out for the food rather than the scene,
go next door to Campo de Fiori instead.

Thanks,
Fredmaster Ben

Excuse the flipper fingers....

I have a question about the restaurant in question in Aspen. Lance
eats there three times a week? WTF? I don't eat at home three times
a week and I'd be damned if I'd eat in one restaurant that often.

Let's see, you hate the Aspen, Philly and the US in general. Yep,

Suspect this is a difference between standard and
dialect. You always have to watch out for the
inscrutable Italian dialects. Many sources write
Campo de' Fiori for the real place in Rome.

I'm not saying the restaurant will be a revelatory
experience, but it didn't seem overpriced for the quality,
which is a typical problem in A$pen. I was there with
an Italian and he enjoyed it (although we did have a
fun time debating whether the waiter was actually
Italian or just pretending and possibly Albanian).

Yeah I hear you. I never really know what to think
when someone is a regular at a restaurant, has their
special table, and so on. Can't they feed themselves?
Though Aspen isn't that big, so if you were going to
eat out a lot I guess you would start repeating yourself.
Maybe LANCE was pissed off because this is the place
he goes to eat without being bugged by autograph
hounds and FBI agents. Or maybe they just kiss his ass
in the right way.

The main thing I noticed being there this year and not
having been in several years was a significant number
of Russian accents - must be the oligarch effect.
