So at this moment, what we(and unless otherwise proven will assume
you) know is ALL based on what we've heard from the media.
The few actual releases from teams and the FIA provide very little
evidence to any serious McLaren involvement, apart from Coughlan being
one of their employees..
The new evidence may change that, but to this moment there is zero
evidence and to NOT convict on superficial or even just inconclusive
evidence is also part of any decent legal system.

McLaren are guilty of possessing another team's relevant IP.

If one isn't liable or guilty one can incriminate oneself with the

The only thing that was determined and admitted by McLaren was the
receipt of the floor information, the release of which is endorsed by
the FIA, since they want all illegalities outed.
Perhaps the means could be questioned, but you have to wonder why the
FIA didn't query McLaren about how they have gained knowledge of the
inside of an undertray, which is usually not exactly a photo
opportunity. Or maybe they did ask, but saw nothing wrong with it ?

As far as i know, the McLaren team have provided all information and
granted any access requested by the FIA to satisfy their
investigations.
I'm not sure what you're trying to get at, because if they are guilty,
they will have done no more and kept or destroyed the evidence. If
they are innocent, they should still do no more and there IS no
evidence.

Punishable, if hard evidence is presented to the court. As of now,
there is none of that. The "new evidence" may change that, but till
then, there is nothing McLaren could be convicted on, except bringing
the sport into disrepute and even that only through liability due to
their employee's wrong doing.
Stepney and Coughlan can be convicted, since they both(especially
Coughlan) have been tied to the case quite well and evidence exists to
that effect.
