Out of interest, one bit puzzles me:
Judge Dowd delivered a victory to both parties in May when he ordered Ewald
to stop using trademarked Jeep parts on his cargo trailers .. and, based on
a precedent called nominative fair use, Judge Dowd granted Ewald the right
to continue to advertise his trailers as "built with authentic new Jeep
parts"

So is that saying you could build it with Jeep bits as long as those parts
don't say "Jeep" on them ?

Woohooo a victory for the little guy, ok partial victory, but a victory none
the less. It's about time some one stood up to those DC NAZI's. (for the
DC spies reading this "eat my shorts" -Bart Simpson). Too bad he didn't
keep the right to use the Rubicon name or at the very least have both trade
marks tossed out on the basis that DC doesn't own the Rubicon Trail (neither
did Denis) and force both parties to re-name their products.

Dave --- The reporter misunderstood the May ruling. D.C. lost on all
of their motions in that ruling, except one. The judge ruled that I
could no longer use NOS CJ-7 tailgates, which I was obtaining from
Willys Overland Motors Inc., here in Toledo. Those tailgates (for
CJ-7's), which had been manufactured by Chrysler, said Jeep on them.
However, he did not prohibit me from using other tailgates manufactured
by Jeep, or anyone else, which did not say Jeep on them. Since that
supply of tailgates had been depleted, and there are no more of them,
that I know of, it was a hollow victory for D.C. I could no longer use
tailgates which I could no longer get, anyway. So what? --- The judge
then ruled against D.C. on all of their motions for summary judgement.
That left D.C. out of ammo with nothing standing between them and a jury
trial. And, there was no way they wanted to face a jury. I, on the other
hand, was still fully loaded with more ammo than Carter has liver pills.
The May ruling was a resounding defeat for D.C. Even the arrogant D.C.
lawyers, from Atlanta, could see the writing on the wall. --- So, you
are correct, Dave. I can still use new Jeep parts, just as long as they

I think you might be getting rubicon.com confused with hardcorejeep.com.
Rubicon.com was Nate's and wasn't even "online" really. Even though Nate had
owned it way before the Rubicon Jeep was introduced DC stold it.

If you didn't see all of the pics posted on there some of which would easily
classify as porn by almost anyone then I don't know what to tell you. I did
see them and when they're spreading themselves to show the pink, I don't
know what else to call it but porn. I understand they were removed later
but he had some pretty trashy stuff going in there when all his legal
problems started. Once again, I would have sued him too if I were Jeep
simply for the pics if not the other issues.

Now answer the question.

The way I see it is, one you think the outcome would be different for Dennis
or two you are just taking "pot shots" at Nathan. Seeing how Nathan isn't
involved in this conversation personally, if it is option two then Bill has
more than one leg to stand on, with regards to his opinion of you.

2. The question is irrelevant, because it's speculative and doesn't reflect
the facts.

Nathan's a good guy, and for the most part has good intentions, he just has
some interesting ideas on copyright and trademark infringement. Although
having naked chicks on his website proved to be his undoing because that's
how D-C found out about it, from a legal standpoint, it doesn't matter that
he had naked chicks on his website. The issue was he used an trademark in
his URL's that he should not have. Later he offered to sell the URL's to
D-C to settle the matter, but that is one of the definitions of
cybersquatting.

I know something about this, I had to deal with a cybersquatter infringing
on my business's name this past summer.

Although you are correct that marbar and I started talking about Nate NO ONE
pulled the porn into this except JB.
I will state it again, there was no porn on jeeprubicon.com so porn has
nothing to do with this. JB choose to bring it up. IMO he is a real cheap
shot expert.
Maybe the guy is obsessed with "show the pink" as he (JB) calls it, he sure
has the discription down. Problem is, it's wasn't being discussed and it had
nothing to do with "rubicon" that was being discussed.

nice try short-stop. the issue youve clearly tried to avoid answering
was the other 5 URLS having _nothing_ to do with the babes. as for
your prudish opinion on what constitutes porn, no one will deny you

Oh, c'mon! Jerry's entitled to his opinion and he's stated since day one
that he thought the 'girls' were offbase for a site purposefully
associated with a specific product. I don't think he's attacking Nathan.
In fact, I believe Nathan took the girls off the site before this
thing was settled making me think that Nathan might have seen their
point himself. Personally, I can see where DC might have come in and
asked for the two (girls/Jeeps) to be disassociated and legally
requested a cease and desist, but the theft of the URL by DC was WAY
over the top and plain wrong. They bullied Nathan because they could.

Dennis had far more in the way of legal legs to stand on and rightly won
his case. Like it or not, the two cases DO have some similarities as
well as differences. Because of Nathan's case outcome, I feel Dennis'
case is a sweeter victory.

congrats!!!! i would love to see DC eat crow in this and many other instances
where their arrognace outreaches their ability/quality/etc.

frankly, the jeep was the ONLY chrysler vehicle i've owned and liked..
evertythign from their k cars, to neons, to a durango my brother had were crap
:(

of 1999, having had to recently protect my business's rights under the Act.
Among other things, the Act prevents unauthorized used of a trademark in a
URL or website. In essence, if someone registers a URL with a protected
trademark as a part of the URL, he or she is infringing on the trademark

thanks dennis. some will never accept this due to various reasons having
nothing to do with the case itself, but having personally dealt with these
people i _know_ that what you say is right.

absolutely. my property has some great off-roading, hunting, fishing,
and some of the most rugged terrain ive ever seen. if youre ever in
the area drop by for some cold bear and hot buffalo steaks. maybe
teach me how to fly fish without hurting myself. :-)

First you find a fish with big fins, ya know, big as wings. Then you
freeze the fish, so the fins and body are nice and stiff. Then, you
throw the thing as hard as you can, first making sure it can't hit
anything and bounce back and hit you anywhere that hurts. Viola, you
have just flown a fish.

As for fly fishing, dirty little secret: all the big ones are usually
caught on worms, grasshoppers, or Pauske's Fireballs.

Ex cow orker moved up to Kalispell just over a year ago....wife gave
edict to move back to California after freezing rear end off last
winter.
