Well, the bubble is so yellowed that it's almost separated completely from
the card, the card has staple holes all over it, and the guard's head isn't
even attached to the body. I'm going to have to ask for my money back.
I'll handle the cost of shipping it back to you. I just want my $90
back.

Good luck. If there is anything I can do (I can't imagine what), but I
would. This dealer sounds like he really doesn't have a clue, but I
really don't want him hanging around RASS.*. It is a shame really that

I quite agree, but the FAQ is there in part to protect us. For example,
if a potential crook sees this in the FAQ, it hopefully will be like the
club sitting on your car. It might send this message, "Go ahead and rip
people off, but beware, we will likely fight back!"

I think that anyone conducting a scam on the Internet goes into the deal
knowing full well that there is a possibility of legal action. It's
just like trying to rip people off anywhere -- there's a price to pay
when yo get caught.
Steve has been doing business on the 'net long enough to know that he's
not going to get away with misrepresenting merchandise and then refusing
to take it back. $90 is not worth losing your online reputation,
especially if you spend so much time trying to sell merchandise.

The Collecting FAQ has a section on Dejanews that explains how to look
up a person's past Usenet history. Remember, there is no set penalty for
conducting a scam on the 'net so there is no standard by which to make
claims in the FAQ. "Only the facts ma'am..."

Kirsten doesn't post that frequently and tends to travel in vintage
circles. Steve generally sells the new stuff so he probably didn't even
recognize the name. Not that it matters any... You can pull a fast one
like this on someone who's been around for years just as easily as you
can a newbie.

I think we all know for the next time. However, usually when retailers
don't accept refunds, they state this.
However she did ask about the condition of the figure and he neglect to
mention that its head was NOT attached! That would be like me selling
my car over the internet "ATTN: Working 1967 Mercury Cougar for sale.
289 cu. in. 4-V Holley Carb., automatic transmission, new engine. etc",
only to have you find out that this engine is sitting in my yard under a
tarp! It is misleading and I think most people would think you would
have every right to get your money back.
But the important issue here is how does this effect our community?
First, it shows that zoman _seriously_ under estimated the quality of
his products. (Personally I trust people like you Keith who have high
standards like myself, but once somebody like zoman lies ... I'd rather
wait and do business with somebody else ... it simply is not worth the
risk!) Second, this has been positive in that MANY people are shocked
that a RASSer actually has duel addresses and very different
personalities (although I'm interested to here what the current story
about Steve's cousin is). Third, reading zoman's emails, I don't like
the tone of his posts ... he defended his actions by stating that he had
been around for a while. If his actions were fair, they don't need a
stamp of date approval (hmm this sounds unclear, but I think there are
still some important issues we can discuss and maybe under another
header).
As far as the reason I've posted on Kristen's behalf ... because I
believe her, she has never posting anything that I haven't thought
"Wow! That is cool." In particular, when I think of her, I remember
her requests to customize 12" Leias. (And her sig.)
Frankly, zoman has been scalping figs in the RASSC.misc group for at
least a short while. I believe he recently was scalping Slave Leia for
$15. That is his right, but it also states that he is ready to make a
quick buck ... probabilistically (based on my experiences) that means he
doesn't care about people ... at least not to the degree that Kristen
does. So from my point of view, how else would anyone in my shoes
respond.
NOTE: I think this goes beyond Kristen's bad luck. :( This is an issue
for a collecting news group and community ... which this IS! :) And
this is something that should bring out discussions. People often think
of RASSC.* as a marketplace, but it is not.
I hope you can better understand why I've been posting, while normally I
lurk in RASSC.* at other times! :) [I hoped this would answer your
questions!]

According to these, your cousin is a girl but named Steve! You bought a
B-Wing off him/her and you lived with the person! Your stories do not
match up. You wrote all of the above and they don't fit together. I am
now 100% convinced that you are trying to cover up a bad situation for
yourself. So on top of your duplicity and bad dealer status, you are
now adding lying to your repertoire. You would have been better off
just confessing.
Bottom line is you said that Zoman was both:
1) a girl you bought a B-Wing from
AND
2) your cousin Steve who lived with you
And finally you acted as if you had no idea who Zoman was. Surely you
would have known your cousins email address if he lived with you.
Please feel free to explain these discrepancies. If you can't, then I'm
afraid you're guilty. I doubt you'll even respond.

John thanks for reposting this. I think this cuts to chase so to speak,
why people are shocked. A headless figure is horrible (unless you are
that collector who is building an army of zombie SW figures). ;)
But I suspect Keith just missed this. Many of these posts are being
crossposted. For example, the RASSC.misc group seems to not be seeing
everything. And some servers are slow, so I don't think Keith saw the
above. But I would like to see what he and others say about the
headless figure.

If those are *all* your e-mail messages, your legal action may not be
very effective. There is no standard of grading, and the description
you gave could certainly describe the same figure that he described
differently.
I think I'm one of the pickiest figure graders there is. I have a whole
list of "flaws" that other people would not even mention. Is it
possible for someone to describe a card as being in excellent condition
and for that same card to have staple holes in it? I think so. I
certainly wouldn't describe the card as excellent, but you would have to
prove that a reasonable person would not describe it in that manner to
show that the seller committeed some sort of fraud.
This grading issue is a gripe that I have... when I sell figures, I
describe ever single minor flaw. As a result, my figures sell at a
considerable discount to what other figures sell for. I am assuming
that the other figures are in the same condition, just that they are
described only as a "C8" rather than with a list of the flaws. On the
other hand, when I purchase figures, they almost always seem to contain
quite a few minor flaws that the seller has neglected to mention
(perhaps not on purpose--he may just not have seen them as worth
mentioning). Usually it is not worth my time to quibble about these
minor flaws.
Now, given that you were not satisfied with what you received, there is
now a question of what obligation to you the seller has. Does he have
to give you a cash refund? I'm certainly no legal scholar, but you
don't seem to have discussed the return policy in your correspondence,
and as long as you cannot prove that the seller has committed fraud,
which would be very difficult for you to do, I'm not so sure you have
any legal recourse.
What the seller has offered to do--replace the item you purchased with
something of similar value--is what quite a number of retail
establishments do. Try to return something to a larger mail-order firm
and see how far you get. Some of them will let you return the item
minus some restocking fee. Some don't let you return things at all. It
is not the seller's fault in this case that you were not aware of his
return policy. Next time you know to ask.
Also, I find it interesting that a number of people have rushed to your
defense in this far from clear-cut case. In similar situations, such
attackers (of the seller) have been described as "jealous". Now, even
though the seller (perhaps?) has a prominent web page, I'm not so sure
I'd be innane enough to accuse people of being jealous of him or trying
to tear him down. Then again, I've seen these same people jabbing at
him for some time, so you never know.

While there are obviously clique(s) of friends on this group who jump to
each other's defense on almost any issue (reducing their individual
credibility in the process, as evidenced by the production of vocal dissent
such as yours to their names in general), that is not enough to assume
such an ideologically collusive group is always necessarily on the wrong
side of an issue. Certainly if one of them was wrongly attacked their
united defense would still be there, but the attack would still be wrong.
Just because earlier wolf cries were false doesn't mean you can assume the
next one isn't true.

Well, perhaps I didn't understand what Kirsten meant when she said that
the "bubble is so yellowed that it's almost separated completely from the
card". This quote seemed to be nonsense to me. The yellowness of the
bubble has no connection with its being attached to the card. I can see
a very yellowed bubble as being described in excellent condition.
As far as staple holes in the card, I can still see the card being
described as excellent if it is flat and unfaded, etc. Some people
might think small staple holes are not a major enough flaw to mention.
Again, grading is subjective. I am a particularly picky grader (and
apparently so is Kirsten), but not everyone is this way. Some people's
C9 may be my C7. Is there anything wrong with an "excellent" card? Who
knows. It depends on who is grading.
As fars as the head separation, there was no question about this, and no
answer. Is that something that's important in a sealed figure? (where
was the head, lying in the bottom of the bubble chamber?) I'm not
familiar enough with these Turkish figures to know how well they were
reproduced or what sort of separation we're talking about here. No one
else seems to know in this thread either--they are just assuming the
figure was trash even though there is little information that has been
posted to support this. What Kirsten or I call a trashy figure may well
be perfectly acceptable to other collectors.
Again, if you don't ask specific questions about the figure (and I am
not sure how it was originally advertised), and if you don't agree on
some return policy in advance, you are asking for trouble. This goes
for purchases through both small-time and also well-established dealers.

GUILTY until proven innocent. Terrible what the net has become. All I
do is try to provide a place where everyone can come and look at all
the new Star Wars toys. That's it.
Sorry, but first I do read all the posts ... headers ... etc.
Here is a summary from my POV.
1) Zoman posted a FS post.
2) Kristen responded showing interest.
3) A series of emails (some of which have been posted to the groups)
ensued
and a deal for an "excellent" carded figure was made.
4) Additional email result when Kristen is not pleased and she
describes the figure as having its head broken.
5) Kristen finally posts warning to newsgroup.
6) Group responds about zoman.
7) I begin to read the posts.
8) People begin to have reason to supect that Sir Steve and Zoman are
the same
person.
WHY? Same address, selling the same collectible coin, same first name,
same last name, prior deals with both personalities.
9) I post and ask, and get replies via mail and group that convince me
#8 is
true.
10) I conclude that Sir Steve *is* zoman. Until I find these school
records, I
will continue to think. However, I will not ever deal with a
person, that
is not only afraid to use his real name, but also steals his
family's.
That is just too risky to me.
But in the future I will call the descriptions "Zoman's (believed to be
Sir Steve)".

By being a scalper, Zoman's credability has always been suspect. He

I agree *somewhat* with your statements about bubbles and cards. A card
with a few staple holes could be considered excellent depending on where
the holes are and how many. A yellowed bubble is often considered
excellent on many figures that are tough to find unyellowed (Australian
POTF). But the headless body is unforgivable IMO.
I also agree that no matter what you get or who you're dealling with you
should *always* specify up front that you can return the item for a full
refund minus shipping if you're unsatisfied. If this is not their
return policy, don't buy from them except face-to-face.

My take on all of this... Steve, I think that there is sufficient evidence
against you (the Rodman coin that you and Zoman had for sale, you claiming to
not know anything about Zoman... even though he is supposed to be your cousin
that used to live with you???). If you are Zoman, why don't you just come
clean? I think everyone would have been a lot less harsh on you if you had
just admitted that you made a mistake. Instead, you come up with an ...
intesting... story about your cousin. It may be true, but don't you think
it sounds like fantasy? Think about it. Re-read these articles and pretend
they were talking about someone else, would YOU believe YOUR story??? Tell
us your name; your full name. Come clean. If you are Steve Comenzco (or
whatever), it is going to be difficult to get people to ever buy from you
again. Once someone starts filling out that check to Steve <fill in the blank>,

I still don't understand the statement that "the card was so yellow that
it almost was off the card" or whatever she said. Yellowness has
nothing to do with being attached or not. That's like sayind the car
was so blue that the door nearly fell off or something unintelligble
like that. Colorless green ideas sleep furiously. Pure nonsense.
To me, this whole fiasco because some people had been wanting to rag on
this guy SirSteve for something (since he is so prominent with his nice
web site). Everyone alsways wants to drag someone else down. Not that
I'm necessarily any better, but at least I know what I'm doing.
I don't approve of this whole tactic of dragging someone through the
newsgroup savages to get them to do what you want. I think if Kirsten
had said something like "oh come on, *please* give me a refund, because
I am really not happy with the condition of the figure. I may just be
a picky collector, but I spent a lot of money on this, I'm a poor
starving graduate student (or whatever), and you really don't have
anything else on your list that I'd rather have in exchange, etc." she
would have had better luck than telling the guy "refund me, or I'll
contact my attorney". What's with this? The guy seemed perfectly nice
in his e-mail message. The whole content of their exchange seemed too
short to bring it to this point so quickly. I've seen people who have
waited several months before posting a "bad trader" alert (and even
then they didn't post private e-mail correspondence without
permission), after having told the person that they would post the
message, and so on.

Well my POTF2 Bib Fortuna's head is not attached...or not attached properly?
Depends on your point-of-view I guess. It's half-hanging out, loosely.
This was a problem apparently common to the Bibs, but because the cloak
around his neck is so thick it isn't a serious flaw. The head is
just slightly crooked and higher up. The original Royal Guard has a head
with a whole cloak coming right out of it. It could just be laying on the
figure, with the cloak still around it, covering the figure, such that it's
again not a noticeable flaw, particularly to a carded figure. This
certainly is possible if not likely to be an overstated flaw on Kirsten's
part. This looked like a key point to the "misrepresentation of
merchandise" argument directed against SirSteve, so I think it's worth some
closer inquiry.

all there is a huge difference between saying a car is blue and a bubble is

case but a discription of quality of bubble as related to age. You see,
when plastic gets old it gets brittle, warps, AND TURNS YELLOW. I can see
a perfectly logical progression from a bubble being yellow to its edges
warping and curling from age, thus pulling itself from the card as it
seperates. I know everyone in this group knew this already but I figured
somebody needed to at least post this so Kieth could quit claiming he
didn't understand.

I disagree that the yellowing process is connected to the warping
process. I have seen very yellow bubbles that have not at all warped
the card, and of course I've seen perfectly clear bubbles that *have*
warped the card (due to shrinkage). I've seen a lot of figures, and
while the age of the bubble contributes to its probability of being
warped and/or yellow, I think once you remove this age factor, the
yellowness and warping are decorrelated.
When describing a figure, is it enough to say that the bubble is yellow
without saying the card is warped (or vice versa)? I think you are
trying to make up an excuse for the nonsense that Kirsten posted.

Alright, this is in no way in judgement of this sirSteve thing, but, you
who complained in this statement of the so called "kangaroo court" are
one of the many who have given them their repective powers. If you
aren't in agreement with them, who from what I can tell are just trying
to warn people, so be it. But I think after you have no insulted
them... We, or should I say me, would not like to see you in a week or a
month, in a string agreeing with them and cheering them on, because we,
once again me, all know you will, because you are all hypocritical.
Remember they were just trying to get to the bottom of things... and
when they beleived they did... they tried to help us all by warning
people.

Nope. Wrong way to explain the anology. C'mon Keith, you claim to be an
excellent grader of the stuff you sell. Why are you pretending that you don't
understand? You would be closer saying "the car was so RUSTED that the door
nearly fell off", using a car as an example. You see, the bubble yellowing is
deterioration of the plastic; rust is deterioration of the metal in the car.
Does that make more sense to you, Keith? ... Sigh ... Probably not.

I don't see the color of the bubble having anything at all to do with
its integrity. Someone with a large collection should look at a bunch
of figures from the same year and see if the figures with yellow bubbles
are more likely to have broken bubbles or warped cards (due to bubble
shrinkage) or whatever.
Anyway, the picture I saw of the card does not show the bubble almost
coming off the card at all, and I think this was just a hyperbole.s I
can't tell the color of the bubble from the picture, but it looks pretty
clear to me.

Well Keith, here is a way to make you sure the value is decreased. What
would you rather have:
1) a carded figure with a head that is loose and falls off that must be
maneuvered to the right place
OR
2) a carded figure (same condition bubble and card) but the head is
attached and shows no sign of falling off
That's right, you'd take number two, as would anyone. Therefore it is
more in demand and a higher value is placed upon it.

I think this explains it pretty well. The head was seperated (divided,
disunited, severed) from the body. Does it really matter beyond that?
Who cares if the head is lying in the bottom of the bubble or totally
missing, it was misrepresented merchandise.
But this wasn't what I was getting at originally. You basically asked
if having the head attached to the figure was "something that's
important." Come on Keith, you're a collector, don't be ridiculous. Of
course that's important.

have it in for Steven are no strangers to judging people on shall we
say less than convincing evidence.
The same people lambast other posters on a frequent basis.
I really do think that if it was the case of them wanting to get to
the bottom of this then they would have shown a little more caution
before jumping in on Kirstens side(on of their own ranks).
Of course we want to protect people ,but like i have said before there
are bad trader posts almost everday on this group.Why do the mob only
jump on this one alledged bad deal?.

There were characters with removable arms. ;) And other characters
whose arms could actually be replaces. RASSM had a thread not long ago
about the number of chopped off arms in the Trilogy and their meaning.
But we never got around to talking about floating heads.

As far as I know, all of those Turkish royal guards (or whatever they
call them) may have loose heads. The American figure has all those
robes, and if you take those away, maybe the head just comes right off.
The seller said the head was on when he sent it, so perhaps if you
jiggle the figure around now, you will be able to get the head back on,
and it will be as good as new. Again, since the card is still sealed,

pic. It appears as though the entire figure is also in a bag.

But that is the big trick. I think in many people's eyes, age is
described or percieved as either yellow or warped or both. When I see
yellow bubbles, while they are not "warped" they do appear loose and to
have fallen off the card in places.
NOTE: I don't have but currently *1* vintage carded figure, but I have
looked at many in stores and shows. (But I'm sure there are people
who've seen more than I have to date.) ;)

I agree that if I was to describe a trading card (these are what I do
have many and feel very comfortable in describing) that I would explain
in great detail the conditions of cards I would trade or those that I
would recieve and might be displeased with. The same is true of MOC or
just carded figures.
However, I can also say that at times you don't want to say too much, as
to run the risk of tuning people out. There is such a thing as too much
information.
BTW: This is now more a post about grading than any warning, perhaps we
should move into a grading discussion again?

I've seen figures in the store with items broken off in the packaging.
The figure *is* broken. Just because it's sealed doesn't mean it can't
be broken. This is not how they are supposed to be. These heads don't
just lift off, they're supposed to be attached.
But that's still not the point I was getting at. I was trying to
comprehend how you could not understand that it *is* important that the
head is attached. I know you're a collector, I'm pretty sure you have
some carded stuff. You would care if one of the carded figures had an
arm floating loose in the packaging, wouldn't you? I can understand the
logic that if the head isn't attached (the Queen Borg comes to mind) and
it fell off in the packaging, that would be different. But from what
you were saying, it sounded like the figure being complete and unbroken
was irrelevant, as long as the bubble was still sealed.

The point is, he should have just accepted the refund. He sent a
package and it arrived not in the condition he claimed it was in.
Reading the emails, he did try to slightly (if not outright strong arm)
Kristen. He was basically saying, I've been around for a long time and
this is the way it works, exchanges, but no refunds.
Now for the value of a headless figure! You bet it is lower, much
lower.
Last year this time, I bought a B-wing. It was described as C8 and
loose. The trader ended up taking it for one last fly through his house
and it dropped. The gun was damaged. :( He sent me back a letter
apolyogizing and said he did not want to glue it back and had spent a
couple weeks hunting for another one at his cost!
The point with this example, is we both know a broken B-wing is worth
less than a non-broken one. And it is what we agreed to. I appreciated
his honesty!

Might you have even considered that there were mailings and inquiry's
occuring BEFORE any public posts were made? There was enough evidence
gathered before "the others" joined in to support Kirsten. Personally I
would like to know why Steve didn't just come out with ANY statement
following Kirstens initial post. Instead he waited and let it carry on
for a day or two before he even tried to make those BS posts...

HAve you even been reading the mail generated in these threads? Probably
not, but I won't hold that against you. The point is Steve was running a
nice scam which relied on trustworthy collectors being decieved via false
pretenses. Steve/Zoman's initial bad trade has been taken care of, now
people want to get to the bottom of the deeper problem. It is a real pity
that you wish to use this situation simply to act juvenile and be a
ninny...

I didn't jump into this because of the "mob" or "Gus' goons" (I like this
name WAY better BTW :-) ). I thought I'd put in my $.02 because someone in
rasscm got ripped off; I felt bad for her and I had something to say. Why?
I guess mainly because I just wanted SirSteve to see how wierd is story
sounded. I always thought highly of Steve's Web page. It had many pictures
of new things in an easy to view set-up, and I am disappointed that the
evidence seems to be showing, by a landslide, that he is zoman. I'm mainly
disappointed because I was REALLY hoping that he and zoman weren't the
same person (say is ain't so Joe; say it ain't so... sorry... I'm a Chicagoan,
and the Black Sox STILL bothers me, even though it was WAY before my time).
I am always bugged when people in our community have a deal go sour (the
Renhoek thing, this one, Chris Stone and yes... even when Lukejedi got
cheated). I have put in my opinion every now and then about these just as
I gave my opinion here.
I am glad that the deal is working out, and the figure is being returned
for a full refund. I, like many others, would like to see this topic dwindle
and eventually be put on the back burner. I wouldn't want to see it forgotten,
though, because there was definitely a LOT to learn from this situation.
There's still no convincing proof that it was misrepresented. I've seen the
pics of it now... The head could have been loose before shipping, the glue
could have been out, and it may have become dislodged in transit. A little
conflict if the dealer fears the customer may have made a switch instead of
the item being damaged in transit is expected. Maybe Steve did know the
head was detached, but maybe he didn't... How can we know? Would anyone
seriously have expected to send a figure like this and not have to accept a
return? Sometimes I lose sight of what Steve is being accused of here...but
if this "misrepresentation" is a major point it just doesn't hold enough
water for me.
