'93 blasts convict questions CBI leniency to Sanjay Dutt

Why is the CBI so lenient towards Bollywood star Sanjay Dutt, asked
convict Yakub Memon while arguing in the Supreme Court on Tuesday
against his conviction and death sentence in the 1993 blasts.

Senior advocate Jaspal Singh, arguing for Yakub before a bench of
Justices P S Sathasivam and B S Chauhan, said the evidence against
Dutt included a confessional statement, which was retracted, and
recovery of arms and ammunition.

"The evidence against Yakub is identical. There are confessional
statements which have been retracted. But even though the standard of
evidence against Dutt and the other accused was same, the CBI chose
not to file appeal against his acquittal from Tada charges," Singh
said.

A special Tada court had in November 2006 convicted Dutt under the
Arms Act for illegal possession of a 9mm pistol and an AK-56 rifle.
But he was acquitted of more serious terrorism charges under the
stringent Tada law. On July 31, 2007, special judge P D Kode had
sentenced Dutt to six years' rigorous imprisonment under the Arms
Act. Dutt has appealed against his conviction and was granted bail by
the SC in August 2007.

The Tada court had said the crime committed by Dutt and his friends
was not ''anti-social, ghastly, inhuman, immoral or pre-planned'' and
did not cause any harm to the general public.

Yakub, the brother of absconding main accused Tiger Memon, was one of
the 12 who were awarded death penalty by the Tada court, which had
convicted 100 accused in the Mumbai serial blasts case and acquitted
23 persons. Another 44 accused have been declared absconders. The CBI
has filed appeals against the acquittals.

Dutt has hardly spent a week in Yerawada jail and he is now happily
acting and attending Big Boss shows and having a good time! If you
have a connection to the CBI's main switch (which is at 10 Janpath)
you can get CBI to do anything! Look what Karunanidhi did - he went
just days before the bail plea of Kanimozhi was to come up and met
the lady in 10 Janpath and a day later CBI says they have no
objection to Kanimozhi's bail plea...but other industrialists CBI
opposes the bail! In fact Dutt's appeal in Supreme Court may come up
after another 5 years, and our Supreme Court judges will then ask why
so much delay in dealing with the case and acquit Dutt of all charges
because of delay!! This is the great legal system of India...!!!
