Bail bond, known as "surety bond" in legal terms can be defined as a contractual undertaking backed by insurance company to get a person free from legal custody under terms and conditions. How to Release a Person from Custody?
You can release a person out court on bail through four different ways. First of all, you can hire a bondsman. The bondsman will charge 10-15% of the bond amount and the rest in collateral. Secondly, you can pay the full bond amount in cash in court or to the jail authority. You can also pay the bail bond through immovable property. In some cases, judges allow the defendant to on own recognizance. This facility is available only when the defendant is accused of reserved issues or lesser crimes. Visiting abroad without court or bail agent's permission will make the person vulnerable for fresh arrest.
What Happens if the Defendant is Arrested Again?
The situation might get more critical if the defendant gets arrested while on bail. At such a juncture, the defendant is sent back to custody. The liability of the bailer is terminated once the defendant is in the custody. In such a situation, you will loose the premium amount. However, if you want to release the person again on bail, you need to make a fresh premium and sign for a new bond again.
Bondsmen are licensed by the state. Hence, the fee they charge is hardly negotiated. For example, if a bondman is authorized to write at 7%, you need to pay 7% as premium. However, the authorized percentage might vary from bondsman to bondsman. All details related to bail bond are available free of cost on Internet.
