The Health Insurance Portability and Accountability Act or HIPAA regulations aims to have patients medical information remain private and confidential. Should there be certain person, health care provider or insurance company worker who wrongly shares any information, penalties can be handed out accordingly. Penalties are applied regardless if the leak of information has been done on purpose or merely accidental. Commonly, people who are proven to be guilty of an information leakage can be fined and put into prison.
To guide you and to answer any queries you may have regarding violations of HIPAA, it would be best to seek the advice of a licensed lawyer. Here are some of the common HIPAA violations that should be avoided.
Staff - In every company or healthcare provider, there are people who are directly responsible for processing and saving all the data of their clients and patients to their system for documentation purposes. Some of these staff members pass along their work to co-employees who are not authorized to have direct access to the patients information. Even the issuance of medical information to staff members who are not allowed or required to do so is a clear HIPAA breach.
World Wide Web The majority of the people all over the world are getting wired nowadays so it is easy to gain information through the internet. A lot of insurance companies and health care providers manage websites of their own where they keep personal and medical information of their clients for theirs and their clients accessibility. However, revealing medical information of a person on the internet without direct consent from the party concerned is a big violation of HIPAA. One example is the event where the information of a woman who had undergone an abortion was publicized on a website that is against abortion.
Safety Issue - One of the many violations of HIPAA committed is when the files and medical information of the patient are not set up with proper security. For instance, information can leak when another employee who is not supposed to have access to the medical information is able to read the records of a patient because the computer is left exposed or open. This incident could cause a misunderstanding of the patients condition and that info could then circulate between family members because of the wrong understanding from the onset of the information read from the computer by someone passing by.
Media - Public figures often experience HIPAA violations through the media. For example, sometimes unscrupulous people sell medical info to newspapers, television, radio and magazines about popular actresses, actors or politicians just to make money. This is wrong and violates policy.
Any kind of violation mentioned above has its equivalent penalty that varies whether the violation is done on purpose or by accident. HIPAA implementation has benefited a lot of people particularly those who have critical health issues. These violations should be avoided to prevent any penalties as well.
