I just want to make you all aware of Senate Bill 329 (attached), which would allow local governments to opt out of the state preservation statute. The bill was introduced in the Senate Transportation Committee and has been referred to the Senate Local Government Committee. As far as I know, no hearings have been scheduled.
In its current form the state preservation statute allows for local decisions by giving the local governing body the ability to overrule SHPO decisions and allowing local landmarks commissions to carry out reviews on the SHPO's behalf.
