Ok everyone, I have an important question for the neighborhood. And
maybe it should be a topic in the next meeting. Either way. If you
remember my last message about the holiday truffles that contain a
small % of alcohol, and my interpretation of a law that meant I would
need a liquor license to sell them, well... I have done some calling
around and so far have not received any resistance from ABC or the
Health Department. Both agencies have basically washed their hands of
the issue and told me I wouldn't have any problems from them, and that
it would be more of an issue of if I receive complaints, and they go
to the mayor, and things get all bent out of shape, then who knows, it
basically would be a unique case in court due to how they interpret
this piece of chocolate.

What it comes down to is... who will be the grench that stole the
holiday truffles from Park Hill?

So my question to the group, would the Neighbor Hood Association or
the residents in this group have any "quirks" about me selling these
truffles during the holiday?

Here are the honest details: The truffles are made by Cocopotamus

I asked them how much alcohol was used to flavor it, and they said it
ranges from less than 0.5% to 3% but its really difficult to measure,
either way, its a small amount, I probably wouldn't even have enough
in the store total to get anyone drunk. lol. The packages contain 5
small truffles, the cost is roughly $12 a box. And we will not sell
them in large amounts to people under 18 just as a store policy. And
trust me, it would be very expensive to abuse.

What are the opinions of any group members?

The question: Do you personally see any issues with Park Hill Pantry
selling Holiday Chocolate Truffles flavored with rum or various
alcoholic flavorings?

As long as you aren't handing out free samples to the elementary
school kids, I have no problem with this!

I would go for it! How do those gourmet stores sell the little bottle
chocolates that only have pure alcohol in them?

I don't see any problems with flavored truffles; but then, I also observe
more "fanatical folk" in our society than at any time in my life... and it's
not a short life by any means...

I guess the question is... would I want to be the "test" subject and go
for it, or play it safe. I mean, we may need to start a fund to bail me

Well it appears from much intense investigation that the holiday
truffles with above 0.5% alcohol levels are considered "adulterated
food" and illegal statewide. So, its not just a Park Hill issue.

We could petition to have the law changed to the federal level of 6%.
Meantime, we will still carry the non-alcoholic truffles that are
amazing. And there are still lots of truffles that are under this 0.5%,
so its not really a big deal. We just ordered 2 more cases that should
be here by Friday. These make great stocking stuffers for anyone.

Well, the good news is I talked to our friends at Cocopotamus, and they
say... there is only 1 tablespoon of alcohol used as flavoring per 90
truffles (18 boxes). Which would cost you near $200.

So it appears the yummy ones are going to be well below the legal
limits. So Cocopotamus truffles are legal in Arkansas, but those liquid
alcohol filled chocolates at the liquor stores are not.

So we should be able to carry the holiday truffles from Cocopotamus for
sure.

That was a lot of research over a piece of chocolate. wew...

Great article! Let's hope it can start to effect a change in these
stupid, antiquated laws!

Which brings up another question... even if you could sell these
truffles legally, would you be able to sell them on Sunday? ;)
