Creative Commons was working on an "open patent license" or "public patent license" for patent owners to openly license the patent rights downstream, in case anyone forgot about this:
http://sciencecommons.org/projects/patent-licenses/

http://wiki.creativecommons.org/CC_Public_Patent_License

Some new content has popped up in the last year.

openpatents.org has popped up:
http://www.openpatents.org/license/versions/opl-simple.php

A nice overview of open patents:
http://en.wikipedia.org/wiki/Open_patent

"Open science business models"
http://www.slideshare.net/technollama/open-science-business-models

Just in general on defensive patent pools (like Open Invention Network):
http://en.swpat.org/wiki/Defensive_patent_pools

Somewhat unrelated to the legal issues:
http://en.wikipedia.org/wiki/Commons-based_peer_production

There have been a number of previous threads on OM about this, so collecting a list of those links [to those threads] would be a good thing to do.
