Police investigating suspected cockfight in city

Although the fights are legal in Oklahoma, a Tulsa ordinance prohibits
them within city limits.

Police are investigating possible animal cruelty in a cockfighting
club after officers discovered a dead rooster early Saturday in an
arena that was set up in a former nightclub.

Officers went inside to investigate about 12:30 a.m. after spotting a
bleeding rooster in the back of a truck in the parking lot of the
former Cabana Club at 3500 E. Admiral Place, Sgt. Wayne Allen said.

A crowd of people appeared to be leaving the club, Allen said.
Witnesses told officers that the man who leased the building had run
away from the scene.

Inside, officers found an arena and a dead rooster in a trash can,
Allen said. Animal Control officers took the winning rooster into
protective custody, he said.

A bartender at the facility was issued several citations, Allen said,
and police plan to file an affidavit for the arrest of the man who
leased the club.

Allen said this was the first case of cockfighting within city limits
that he'd heard of and that police likely will try to file felony
complaints of cruelty to animals against the people involved.

Oklahoma is one of only three states -- including New Mexico and
Louisiana -- where cockfighting is legal. A movement to ban the
activity, which is believed typically to include illegal gambling, has
been under way in Oklahoma for several years, and Congress has before
it legislation that would ban the interstate transportation of birds
for fighting purposes.

Cockfighting typically features specially trained and bred roost ers
that wear sharp blades, called gaffs, in fights to the death. At least
40 cockfighting pits are believed to be located across the state.

An initiative petition calling for a vote on a ban was found to have
insufficient signatures by an Oklahoma Supreme Court referee, but the
full court later reversed that decision. If the petition withstands
other challenges, it likely will be placed on this fall's general
election ballot.

While cockfighting remains le gal under state law, a Tulsa ordinance
prohibits the activity within the city limits, said Bob Whitely,
assistant director of the Tulsa Animal Shelter.

Whitely said the rooster that was taken into custody is recovering
well from his injuries and probably will be adopted by someone who has
experience raising chickens.

Why ya' reckon the guys that like to fight their cocks are so opposed

I would just like to know why cockfighting isn't covered under the laws

Because the bible says that man was given dominion over the animals, so for
some people that justifies watching birds peck each other's eyes out in the
name of sport.

There's probably some excemption somewhere that excludes fighting
fowl as being "animals"... What I'd like to know is why aren't these
things being shut down because it is a "gaming" sport and betting on
such things is illegal in the state.

The Oklahoma Court of Criminal Appeals found that the legislature didn't
clearly intend to include "fowl" in the category of "any animal" when
it passed the animal cruelty statutes. The court pointed to other
examples of the legislature distinguishing between animals and fowl and
the danger of overbreadth. An example the court gave was using live
minnows to bait hooks.

See Lock v. Falkenstine, 1963 OK CR 32, 380 P.2d 278.

So there you have it. Fowl aren't animals.

Evidently fowl are 'plants' or 'minerals' in Oklahoma.

Chickens enjoy a special status in Oklahoma don't ya' know? Arkansas
too, only over there they breed 'em for fightin' and eatin' and God
only knows what else. Why I've even heard rumors there are no fly
zones over some of their huge chicken farms because a few years ago a
low flying military helicopter literally scared the shit out of an
entire clucking community and most of 'em died of fright.

There's just something about the Average Okie(tm) that makes them
addicted to 'blood sports'.

Of course when you realize the Average Okie(tm) is also a coward, the

In a way, I gotta' hand it to the Arkies.
They are a lot more up front about their weirdness and don't try to
wrap it in the Bible on Sunday morning.
I respect that, sorta'.
At least you know where they stand.

makes sense to me,coming from a state where moststill consider dogs dumb
