How old to leave a child alone?

My wife and I are separated, and she has custody of our 10 year old daughter.
She has recently started leaving her alone during evenings for 2 1/2 +
hours. My daughters says that she is OK with this, as long as the dog is
with her (dobbie/black lab mix - mid-sized dog).
Is this considered safe in NY? What does the law say about it? Anyone
know?
I am about 1 hour away by cab, so I wouldn't be able to get there very
quickly in an emergency even if she did call me; and I am usually
given no advance notice when these things happen.

This would only be wrong if you were doing it. My ex would leave
my four year old daughter alone for 45 minutes at a time while she ran to
the store. Had no choice but to call the Child Protectives... what a joke
these liberal bastards were. Went over to my ex's house a week after
calling hotline and then suggested it was ok to leave child for short
periods.
Just don't you try this or you will end up in jail.
