COPYRIGHT: ISSUES: The Fair Use Issue: Some Sources of Information and
Discussion
A great deal of ink has been used in a large number of places regarding
fair use. This post will provide links to a few selected resources for
those interested in or needing to know more about this issue for the
purpose of providing some starting points for learning more about this
issue so important for the exposition of ideas and academic research.
Fair use
From Wikipedia, the free encyclopedia.
<http://en.wikipedia.org/wiki/Fair_use>
"The fair use doctrine is an aspect of United States copyright law that
provides for the licit, non-licensed citation or incorporation of
copyrighted material in another author's work under certain, specifiable
conditions. The term "fair use" is unique to the United States; a similar
principle, fair dealing, exists in some other common law jurisdictions.
(US trademark law also incorporates a "fair use" defense. While the names
are the same, the doctrines are quite different.)
Fair use makes copyrighted work available to the public as raw material
without the need for permission or clearance, so long as such free usage
serves the purpose of copyright law, which the U.S. Constitution defines
as the promotion of "the Progress of Science and useful Arts" (I.1.8),
better than the legal enforcement of claims of infringement. The doctrine
hereby attempts to balance the interests of individual copyright holders
with the social or cultural benefits that follow from the creation and
distribution of derivative works. Insofar as this doctrine protects forms
of expression that might otherwise be enjoined as copyright infringing, it
has been related to First Amendment free speech protections in the U.S.
Constitution."

Intellectual Property, Copyright, and Fair Use Resources

"The compilation of links on this page is for faculty and students who
wish to find out how current copyright law effects their use of
intellectual property. Under U.S. laws, faculty and students have rights
to use intellectual property for educational (non-profit) activities
called "fair use" rights. These rights are restricted rights, and so it
is a very good idea to become familiar with both the fair use rights and
the restrictions of copyright that still apply to educational activities.
The copyright law pages provide the statute that describes fair use
rights. (Text updated to April, 2000.) The Consortium for Educational
Technology for University Systems pages have a very good discussion of
fair use rights for faculty and students."
