On the EDTECH discussion group that is a part of H-Net, there has been an
interesting discussion and presentation of sources of royalty or copyright
free music resources on the internet. I suggest, however, that one search
the archives of that discussion group for recent and past posts about
royalty free and copyright free as content on this subject in general may
be helpful by application to copyright free as applied to music sources
and one may also want now or later copyright free art and other media.

finding resources about copyright or royalty free music. By the way, I
suspect that some music could and may be royalty free but under copyright
as the owners of the music may not charge for its use under some or all
circumstances, but, nevertheless, require attribution. Please also
remember that while music may be out of copyright and now public domain,
specific recordings of that music will still be under copyright as the
performance is under copyright.

Hi David

Thank you for this wealth of resources on copyright free music.
Copyright is already complicated, but author's rights applied to music
is a maze, because music doesn't exist per se, like a painting for
instance, but through interpretation.

And thus interpreters are in turn "co-authors", whose rights - royalties
in particular - are often administered by the same society as the
original author's (composer's). In Italy, for instance, the competent
society is Società di Interpreti, Autori ed Editori, SIAE. "Interpreti"
does not only cover musical interpreters, but also actors and
translators in the case of a publicly performed work, who are entitled
to a percentage of tickets'sale and of royalties for broadcasting a work
and on the sales of CDs.

Traditional European broadcasting entities usually pay a yearly lump sum
for music to whatever is the equivalent of SIAE in each country. They
still have to keep a detailed (to the second in theory) log of all music
they broadcast, so that the lump sum can then be subdivided between the
various right holders.

Now with internet broadcasting forms - streaming and podcast for
instance - applying this complex system may not be feasible. But it
still exists, so far.

And it is one point where "copyleft" initiatives like Creative Commons
(CC) <http://creativecommons.org> or Licence d'Art Libre (LAL)
<http://artlibre.org/licence.php/lalgb.html> may encounter concrete
application difficulties.

In fact, the societies like SIAE who manage rights for performing arts
tend to impose their copyright license model and are not likely to
accept autonomous license choices by authors: this issue came up in the
LAL translators' discussion list last year. And though the brillant
cartoon on the CC site, with a young composer putting her song under a
CC license (see <http://creativecommons.org/about/licenses/how1> and
ff.), works egregiously to explain how these licenses work - things
might not be as easy for a composer in the concrete world (at least in
Europe).

Nevertheless, these copyleft licenses may well be showing the only
possible path in the double maze of rights administration for performing
arts and of the new proliferation of broadcasting possibilities. CC more
than LAL, because LAL is a one-version-only rather conservative
adaptation of the GNU Free Documentation License, whereas CC licenses
are made of modules, and could thus evolve more flexibly.

(Another advantage of CC is that you can search for content under a CC
license at yahoo, under <http://search.yahoo.com/cc> (see George
Lessard's "[Net-Gold] YAHOO ADDS SEARCH FOR CREATIVE COMMONS CONTENT"
28/03/2005. And the search engine of Creative Commons itself
<http://creativecommons.org/find/> allows you to search the Internet for
a particular type of work (any - audio - image - interactive - text -
video) under a CC license, and its results come with symbols showing at
a glance which CC license has been chosen).

NB: I'm not a lawyer; the above is based on:

- nightmarish SIAE form filling for sharing the equivalent of the price
of a cup of coffee each time a play my husband and I had translated got
performed by an amateur company at an almost deserted parish hall;

- my daughter's similar red tape experience in Switzerland about a
Russian play she translated for a Geneva theatre;

- some free lancing for radios (state and commercial);

- a long e-mail discussion about LAL and CC licenses last year, between
members of www.ynternet.org and promoters of the LAL.
