document.build is working differently from AR, is it intended?

While trying to port the AR nested attributes functionality to MM I
realised there is what I think a serious problem with MM's
associations using build.

http://gist.github.com/346882 has two currently failing tests that
demonstrate the problem.

If this is intended then I'd like to hear why.

Not intended but I am aware. I can't say that I would consider it serious. I'd be open to a clean patch for it. There have been a few in the past but they ended up hacky.
