21st September 2012, Japan Federation of Bar Association published a written opinion about EMF issue.

The Bar association produced the written opinion related to EMFs problem to the Ministry of International Affairs and Communications, the Ministry of Environment, the Ministry of Economy, Trade and Industry, and the Ministry of Health, Labour and Welfare.

 

The Bar Association recommended:

1. Governments should study safety measures for EMFs, establish “EMFs safety Commission (a tentative name) “to protect public health and environment, and organize and legislate including bellow contents.

(1)  A content of organization

“EMFs safety Commission (a tentative name) “should be independent organization away from the authorities that have a relative industry. The member of commission should be chose among different various opinion related to EMFs, after having clarified supply of profit from related company.

 

(2)   A temporary legislation

 For safety measures against EMFs, an area nearby kindergarten, school, and hospital should be specified as “sensitive area”  according to preventive principle. It should be consider to set more strict legislation in sensitive area than others.

 

(3)   Public information and procedure legislation related to radiation emission facility

[1[Government should consider a realization of the system that   explain and discuss the new construction which emit EMR with residents, when build new radiation emission facility, such as mobile phone base station.

[2[Government should set up a public information system to inform to inform the place with EMR emission facility, such as mobile phone base station.

 

2. An investigation

(1)    Government should fairly set up an investigation institution by researcher who having clarified supply of profit from related company, and carry out bellow research and analysis.

[1] An investigation of residents who lives around high-voltage power line and/or mobile phone base station.

[2] An investigation into mobile phone use and health damage.

[3] An investigation of occupational EMFs exposure of workers who employed in a specific industry, such as electric power company and mobile phone operator.

(2)Government should reconsider a present EMFs regulation, when new scientific knowledge would be obtained by above-mentioned investigation.

 

3. Measures for EHS

For persons with EHS, Government should consider any measures, such as to make a mobile phone off area in public transportations, in the point of human rights security.
