My case was applied in Cairo in July 18th of 2000. I was scheduled for
an interview. However I requested an interview waiver from my attorney
help. The CAIPS notes was ordered and received.
The CAIPS notes says Master's Degree received. Bachelor's degree recd.
Employemennt letter recd.
When I go to site for status, it shows as case withdrawn, I therefore
contacted attorney office.
I was informed by the attorney office that the case has been probably
moved to New Delhi. That is the reason they say, the site says
withdrawn. They are not 100% sure but they are taking their best
guess.
Has anyone experienced a issue like this ?
I was informed that the application date will be kept the same as July
18 2000. This should make me come in front of the queue. I am not
100% convinced of this
Is this a valid statement by the attorney office about retaining
application date? Does it mean that they will pick up application
right away since processing time in India is 57 months from date of
application.I am already 61.5 months old.
The reason that my attorney office is giving is that: the employment
that I have is not in Cairo and hence the New Delhi consulate has to
verify employment so the case has been moved there. Prgoram Integrity
reasons is what attorney office is saying. I am not sure as to what to
say.
What are my realistic chances of getting PR at all ?
Is it better to withdraw and reapply ?
I am a little frustrated and about hang up the boots.

I was advised today by my attorney's office that the case has been sent
to India for processing. The reason is that Cairo consulate doesnt
have the necessary infrastructure to process my papers. I respect
that. When I applied 5 years ago, Cairo was the fastest and there was
no rules against this kind of a policy.
I was told that the original date of application is to be honored by
the CHC in Delhi. Is this correct ?
The current timelines in Delhi are 80% of cases in 57 months. My case
is over 61 months. Does it mean that my case will move to the top of
the queue almost ?
What can I expect in terms of the interview, a waiver ?
When I applied I had a BSc in Microbiology (its a 3 year degree in
India), I went to Australia for education and the university there
recognized the 3 year degree as a valid undergraduate degree. I could
not complete education due to other issues. Subsequently after my
return from Australia I have worked and in total I have 7 years of
experience in the IT industry.
I also have obtained a M.S in Information Technology in 2005. It is
considered a Master's in Indian education and professional
institutions. How can I make sure that the Canadian authorities
recognize it as a Masters degree (since my Bachelors is a 3 year
degree) ?
Some of companies I have worked for have either closed down or merged
or acquired by other companies. How can I prove to the CHC folks that
this is the case. Will an affidavit prove that my work is indeed valid
?
If I get married (which I plan to), then can I still attach my wife to
the application ?
Is it helpful or harmful to do that ?
I hear different accounts all the time, some say dont do it some say do
it.

Yes, original date will be honored but it means really nothing.

No, it will not. It will land in the pile of similar cases transferred for
the same reason.

It all depends from quality and conclusiveness of your application package.
If your representative advised you to apply through Cairo in 2000 then I
don't have much faith in quality of your package.

You need to submit your degree and original transcripts in university sealed
envelope. If it is from accredited university then it will be accepted.

No, such affidavit is self-serving. You need to provide all evidence you
have - payslips, contracts, appointments, reference letters, etc.

If 80% of cases are solved in 57 months and my case is 61 months old,
why do you say that my case will end up in a pile. Isnt there any
accountability at all for the CHC people ?
Are you saying that the competency of CHC's is so bad that expecting
anything from them is just plain useless ?
With all due respect, how can I prove anything from a company that has
closed down (due to financial constraints) or merged or has been bought
out ? Having pay slips of companies 6 or 7 year old is near to
impossible. Are you then saying that I might as well give up my dreams
?

But under the approved by court settlement agreement all cases submitted in
2000 (like yours) must be completed within 24 months from the Notice of
settlement - so, your case will be completed by summer 2007.
If you cannot prove claimed work experience then it won't count - it is your
burden to provide conclusive evidence. Fact that company may not exists or
has merged with another is irrelevant - records still exist and people you
worked under or with are still around. If you can't provide reference
letters from employers then provide other evidence and letters from former
supervisors and/or co-workers. If you won't then sorry but unproved
experience won't count.
If your attorney didn't tell you all of that then he is completely
worthless. Do you have copy of letter your attorney received from CIC
stating that your file has been transferred to New Delhi? Demand it.
