Poor design. That's just asking for a deadlock on party lines. With most
Courts, that can't happen during normal operation[1] due to them having an
odd number of judges.

[1] When a member dies/retires/is fired/whatever, that isn't "normal

I could have it wrong, but I read S. Checker's post as meaning the open
position was the odd one which, when filled, would be the tie-breaker.
