Can I use Horde in a commercial application?

I would like to develop a commercial php script. I'm planning to use
Horde's API for some parts of my software. I won't close horde's source
codes, of course. But I will have to close my application's codes. Which
direction should I go? I don't wanna have legal issue

Check for newer versions broke

When visiting the gear -> administration -> configuration -> "Check for newer versions", a blank screen comes back. In my apache error log, I receive this error message....
