Random No Parking Signs and Towing

I wonder if someone has a better suggestion for me.  We went away last weekend and parked the car on Hermann by Church.  There were no "no parking" signs at the time (on Thursday).  However and subsequently, there was a hand made No Parking sign posted and we were towed.  Fortunately, one of our friends wanted to borrow the car and when he looked for it, gone.  Apparently, it was towed on Friday.  The car got a 53.00 ticket plus $417 towing and storage. I am shocked and dismayed that the city can randomly put these signs.  What if you are traveling?  I sent a note to Bevan Dufty's office asking if the city has the right to do this.  I am not sure if it's some contractor company or city itself that put the signs.  I sent a note to Bevan on Monday but have not heard yet.  I also faxed it to his office and copied one of his legislative staff.
 
Does anyone have another recommendation for me?  I feel this is illegal to just put signs of no parking when the nrighborhood was never notified had many of our street parking would be unavailable for some time.
 
Is this a new way for the city to make money from its residents because they don't have enough cash?

It's a very old way for the city to make money, and they are especially desperate now in a recession. The city collected more than $88 million on parking tickets alone for the last year I looked at:

How do I contest or prove this? The city is the one that is randomly
posting the signs. I sent a letter to Bevan Dufty as I believe he is
on the Supervisor committe for MUNI (Parking is part of MTA) and
Neighborhoods etc.

Any other thoughts?

The City can give a week to 3 day notice for the No Parking, it depends on the situation. The City use to put the No Parking signs w/dates out a week before but people were tearing them down so it changed to 3 days before. There is a lot of PG&E and utility work happening in the City right now and it's disruptive and annoying. Sorry about your car and the money.

Hi Vallie,

Thank you for the clarification. I am puzzled however why the city
would put the burden on the residents for people who tear down signs.
They could have easily informed us by asking PG&E, Public Works or
whomever is needing the no parking to notify us with notices around
the neighborhood. There was none. What I have seen however are random
notices. For example, the signs on Fillmore by Duboce have Tape on
top of the dates because the dates have passed. Is that truly
notifying the public and residents. The no parking signs seems to be
different times as well.

I am really disturbed by this behavior whether it is the Director of
Parking and Traffic who allowed such action or another entity that
towed cars (like the construction company or PG&E). This is a
neighborhood where people have cars and it is residential. It is not
like downtown where people go home.

Do you know what the appeal process is and what can residents ask the
director of parking and traffic? To whom is he or she accountable?
Decisions like this cannot be random and cannot be at the whim without
due notices to residents.

Interesting that this should come up now... We're on Divis, and we've
noticed that the contractors have started pulling the no parking signs
in the evenings, and then putting them up again in the mornings.
We're not sure whether there have been complaints about the lack of
parking or what, but they've been pulling the signs when they wrap up
their work in then afternoons so that the parking spaces are available
(where their equipment isn't parked!). The other morning, we were
leaving for work, and there was a new sign up right next to our car.
There had been no sign the night before. If there's no sign when the
car is parked at night, but a sign is put up the next day, how can the
city enforce this. Does this mean that we need to take dated photos
of our car/parking/surroundings every night, just in case? That's not
reasonable.

Your concerns are legitimate. With all of the work that's been going
on for the Divis beautification/landscaping, our parking has been an
absolute nightmare, and the inconsistency of the no parking signs has
turned into an annoyance beyond belief. We've just had to assume that
the car has to be moved by 8am every morning. And so far, we've been
right. If the city (or its contractors) are not required to provide
ample notice to the residents impacted by the parking restrictions,
what are the residents to do?

Manny, I'd be curious as to what you find out with this. We haven't
had a ticket (yet!), but it has definitely made parking significantly
more challenging in an area that is already over populated with
vehicles.

Hi Marty,

I wrote to Supervisor Bevan Dufty. I said there are other neighbors
from the Lower Haight group that have expressed concerns. Can I
either forward your note or can you send a note to Supervisor Dufty at
bevan...@sfgov.org. He is my Supervisor so hence I wrote to him
but our group is in district line so there may be 2 different
supervisors.

Supervisor Dufty wrote to the Northern Police Department and I got a
return phone call today from an Officer Corey (spelling). He did some
investigations and said that the citation I received from DPT was at
the request of DPW, Muni or C&T construction. He gave me a phone
number and I am following up on this now.

Other neighbors who are concerned with the random signage and
potential tickets or towing should probably voice their concerns to
City Hall.

I received a call from the Northern Police Station (Officer Corey) and
City's Dept of Parking and Traffic (James Lee). After further
investigations based on accounts on file, the DPT determined that the
construction company did not provide adequate notice in towing my
car. Essentially, if any of the construction or PG&E need access to
where our car is parked and they didn't provide adequate notice, the
car is supposed to be moved to a different location so that if you
call the police to say your car was stolen they can say it is in a new
location. Otherwise, the construction company is responsible for the
towing fees.

As a result, Mr. Lee has requested the Towing Hearting Court to
reverse my tow and have construction company pay for it. I will be
sending him the receipts. I want to thank Supervisor Bevan Dufty for
getting me to the right person who could assist me. Happy Holidays
