Should you be able to initialize tabs on an empty list?
$('<ul/>').tabs().tabs('add', 'foo.html', foo');

Initializig an empty set was working once. Looks like it doesn't now?

Yeah, there's a ticket for this: http://ui.jquery.com/bugs/ticket/3683
