Европейският съд излезе с решение по спор между по-ранна марка KIN (класове 3 и 35) и по-късна марка KEEN за същите класове.

Според съда OHIM правилно е заключил че двете марки са сходни до степен да объркат потребителите.

Стоките и услугите при двете марки са сходни и идентични. Марките са сходни от фонетична гледна точка. Макар и да има визуални разлики съдът счита, че марките могат да причинят объркване сред по-голямата част от потребителите в ЕС.

The European Court ruled in a dispute between the earlier mark KIN (Classes 3 and 35) and a later mark for KEEN for the same classes.
According to the Court OHIM was correct in concluding that the two marks are similar to the extent to confuse consumers.
The goods and services for both marks are similar or identical. Trademarks are similar from a phonetic point of view. While there are visual differences, the court held that the marks may cause confusion among the majority of EU consumers.
