Hey Everyone!
I posted this on facebook last night, so in case you didn't see it . . . (also, Kim, I can write up an IP report on this for a month when you need one; just let me know):

The Library of Congress/Copyright Office has just issued the new 3 year DMCA exemptions to prohibition of circumvention (i.e. hacking) and has expanded them further for the educational community, from the 2010 exemptions

(I attended and testified at the hearings in support in June 2009 and June 2012 [all an activity started through our caucus]).

For the new exemptions, check out page 65266 et seq. http://www.copyright.gov/fedreg/2012/77fr65260.pdf

They basically expanded the exemptions to include more types of media, and extended the exemption from "college and university faculty" to include "college and university students, and kindergarten through twelfth grade educators." They renewed the exemption for "noncommercial videos" and "documentary films" and added "nonfiction multimedia ebooks offering film analysis," and stated "For purposes of this exemption, 'noncommercial videos' includes videos created pursuant to a paid commission, providing that the commissioning entity's use is noncommercial" (speaking to nonprofits, I should think) . . . I haven't studied it in depth, but in the initial review, it could not be better news -- yay for public comment!! (Also note since the last exemptions were issued, we have a new Register of Copyright appointed - very cool).

Great news.  Thanks for sharing.  It has been a good year for fair use!

Thanks, Martine! Would you please send an update to the CCCC Exec.
Committee? They should know about this, too. Best, Karen
