But even it it were not. The 9/11 bombings happened on AMerican soil
and those that are charged, are charged under American law and have to
same rights as anyone else.
If foreign nationals did not enjoy the protection of American law then
no Ambassador or Tourist would ever set foot in the USA.
The U.N. charter on Human Rights applies to the rights of citizens
within their own countries.

No, they do not, except as provided by law respecting the rights of
legal aliens, even if the crimes were civilian crimes, as they were
not. By law and by what is just, they have a right to be tried in
military tribunals without appeal to any civilian court.

Foreign nationals have legal rights, given by Congress, and not the
Constitution, and *usually* the same rights as citizens under most
circumstances, but the very act of issuance of restricted visas
implies aliens as having either legal or illegal status. Believe it or
not, there is no visa available to aliens to commit acts of war.
Aliens committing acts of war are *invaders* and not foreign nationals
gone terribly wrong in their visa-permitted activities.
