Hi,
I just started using GamePath too and prior to that I was doing some
research on the whole issue and the thread below can encapsulate most
of the issues of people concerned:

Basically read up to page 3-4, most of the general issues can be
addressed there, as a summary from my reading:
a) Using a proxy isn't against TOS if you are using it just to connect
for the purposes of playing the game (to use a RL example, say if you
are a college dorm student, you'd likely be going through the
college / uni's proxies to get onto the internet)
b) Using Gamepath or Lowerping or any other proxy service is still a
Cavaet Emptor issue (Buyer Beware) meaning that you will be taking a
risk regardless of what is or isn't in the TOS. This is because at the
end of the day, Blizzard can still shut you down no matter what if
they have grounds to do so.
c) Basically connecting from different locations is the prime issue,
if you're not shifting between a Cyber Cafe / LAN shop and your home
where you've set up the Gamepath connection then theres not really
much difference in geographical location. That being said while there
are many claims of being banned for using Lowerping quite a few of
those people have alot of other offences (like exploiting etc) tagged
along with it. So assuming all of us are pretty law abiding here we
all should be okay even if we're leveling alts etc.
All the above is my own personal opinion btw, so its not a official
stand by Blizzard on the issue but I present it here so that people
can get a clearer picture.
