Dear All,

Good Morning. We have a limited number of Stilt Parking in our society. The car parking along the wall is adequate to provide parking for one car per flat. Thus the Stilt Parking is available for additional cars. What are the options for allotment of these extra parking lots?

(1) Can we auction these car parking slots, so that society gets additional funds for major renovations or for welfare of the society members.  Or
(2) Can we allot these parking slots to a few members decided through draw of lots, against a refundable deposit (say Rs. 100,000/-)?  Or
(3) Can we give it on a monthly rent?
(4) Any other Option?

We shall be highly obliged if any of you could let us know legally viable options.

The best option is to rent out to highest bidders for one year and conduct bidding every year. This will ensure equitable opportunity to all residents every year with regular income at increasing rates to society as a body.

1st check as per Building Plan submitted to DDA by Architect what is this space for ?

Is it for Visitors Parking? If so you can not reserve or give it out to any one else.

As a matter of fact if the COMMON AREAs of the society in any manner can not be Rented out or Sell out in any form to any member if its for COMMON Purpose.

so check all drawings and documents first

Thanks a lot! You are right. Part of the stilt area is common area and can not be used for parking. The remaining Part of the stilt is ment for Parking lots.
We want to do justice with this stilt area which is available for Parking. We have separate parking area for guests near the entrance gate.

Common area cannot be sold and sale is totally illegal,as can be referred to many high court rulings .
So by auctioning even for common purpose will further create confusions.
Best thing should be to give this stilt parking on nominal basis by draw of lots ,turn wise to stakeholders/members periodically. Any sale otherwise cannot be registered by paying stamp duty.
