Please see attached order. Highlights: 

1) In his order dated 9th May 2012, CIC Shailesh Gandhi order the PIO of Medical Council of India to disclose all correspondence/emails Medical Council of India had between Max Hospital & its doctors, Ethics Committee & its members, Board of Governors of MCI and any other organization/individual after 08-03.2011, including file noting. He also asked the MCI to compensate the appellant Rs 3000 as per the provisions of Section 19(8)(b) of the RTI Act for the loss and detriment suffered by him in pursing the appeal and getting the information late..

2) The Appellant S P Mancharida (Manchanda?) points out that this is a case of medical negligence which resulted in his daughter’s death in May 2009. He is naturally aggrieved and has been pursuing the matter in the MCI since last two years. The Ethics Committee of MCI has reportedly found four doctors guilty but is now delaying awarding any punishment since past 14 months. 

3) "The complete collapse of mechanisms to punish people who have been found guilty is extremely damaging for society and denies victims a sense of justice being done," noted the Information Commissioner in his order.

4) "The Commission realizes that the Appellant has been harassed by not being provided information on query-5 without any reasons. Harassment of a common man by public authorities is socially abhorring and legally impermissible. It may harm him personally but the injury to society is far more grievous. Nothing is more damaging than the feeling of helplessness. An ordinary citizen instead of complaining and fighting succumbs to the pressure of undesirable functioning in offices instead of standing against it. Therefore the award of compensation for harassment by public authorities not only compensates the individual, satisfies him personally but helps in curing social evil," the CIC said.
