Dear All,
 
The President of the Management Committee of our Society is unable to continue due to other pre-occupations and the Vice President does not stay
in the society premesis and therefore unable to sholder the responsibility. Other office bearers and members are also not very keen to take the responsibility.
Under the circumstances it has been decided to seek nominations from the elligible members and call for elections.
 
I wanted to know from the experienced and learned members of the DF the method of conducting the elections.
Do we have to approach the Registrar?
Who can be the Returning Officer?
Can we request a respectable member of other Society Or a Gazeted Officer to be the returning officer?
Do we have to choose a person from a list of persons  authorized by Registrar to be the returning officer? Where can we get such a list?
Or Do we have to get the elections conducted by the person nominated by Registrar?
Do we have to pay any fees to Registrar office for holding the elections?  
 
We shall be grateful if the learned members of DF could suggest the procedure to be followed in holding the elections under the present circustances.

This is the other side. While we blame Politicians and Political Parties in our OWN SMALL WORD our Management and Governing Bodies not able to deliver.
Anyway it always good for a change.. All the very best.
If your society have conducted the draw of flats and complted all formalities you dont need to got to RCS for returning officer Please refer DCS Rule on Election.
Appoint any one who is not your soceity member, preferbly choose some one fron neighboouring society with Integrity and knows about rules and procedure.
You may also ask from RCS , I think in some latest court direction appoinment of RO by RCS has to be within some weeks.
Yes if you want RCS appointed RO then the expenditure will be higher as you will have to pay for them
I will try to share some old documents of my society where procedure of Elections.
As our society always request for RO and normally one of the SDM normally the RO, Last two time it was SDM Hauz Khas and this time it will be SDM Chanakyapuri.

The counting of votes polled will be done on the same day and the result of the Election shall be displayed and announced at the venue of General Body Meeting i.e. Society’s office. The notice issued by Secretary of the Society calling AGM of the members is also enclosed herewith

 

General instructions:   

 

  1. If a member is in default in payment of the sum demanded by the co-operative society or has transferred his interest in a cooperative society to any other member or any other person without the approval of the competent authority, he shall have no voting right in the general body meeting of the co-operative society. However, defaulters shall be allowed to clear their dues before the date of filling nomination only.
  2. Notwithstanding anything contained in this Act, a person shall be disqualified for election of office in the committee (as per section 35(7) of DCS Act.2003).

a)      If he holds any such office on a committee of another co-operative society of the same type.

b)      If he hold any such office on the committee of three or more co-operative societies of a different type or types.

c)      If he has been held guilty of any of the offences as enumerated in section 118:

d)     If he is an officer of a cooperative society which has not got its statutory audit completed within the statutory period prescribed in this Act or

e)      If he fails to give a declaration on oath about his eligibility for contesting election as prescribed (Every member contesting election will have to file an affidavit sworn before notary on a stamp paper of Rs. 10/- in the prescribed format  to be obtained from societies office along with nomination papers.)

  1. Provided that the member who has sold his/her flat on power of attorney (POA) or agreement of sale shall have no voting right in the affairs of the co-operative society, however the power of attorney holder shall acquire voting right (As per section 91 of DCS Act.)  

The list of eligible voters, defaulters and those who have alienated their rights by virtue of power of attorneys will be displayed at Society’s office. The list has also been forwarded to RCS office. The list is final in all respects and no changes can be made in it till the election process is over as per various provisions of the Act.

 

  1. There will two reserved seat for Women.
  2. No person would be allowed to contest simultaneously on two posts.
  3. Any Suggestion/Objection on proceeding be kindly inform in writing.
  4. In the end, it is brought to the kind attention of all concerned that the mandate of Returning Office is to ensure transparency and accountability in the election process. The job of preparing electoral rolls is separate and any objections in their regard may be taken at appropriate form i.e. with RCS office or with the Managing Committee. All concerned are requested to cooperative with the undersigned free and fair election

Dear Mr. Chitnis,
 
As reji rightly pointed out, there is no need to approach RCS if you society's allotment is over. Request your current President to call a special general meeting with an agenda stating that he would like to dissolve the committee. In the AGM, his resignation will be accepted and the members can appoint an ad-hoc committee. the Ad Committee can appoint a returning officer with impeccable record and also provide such officer with the electoral roll.
 
Some procedure and paper work should be followed - otherwise procedural irregularies will become a headache to deal with at a later stage.
