Anyone has any idea about this project. I have one bed apt. Paid 35% and construction of my building not started yet. It was suppose to be completed by dec 2009. Any Suggesstions?

I have also paid 35% in QPoint. I have received legal notices to pay more. I met them and asked any assurance for completion They cannot give any completion date assurance in writing that is why I am not paying anymore to Mazaya.

Hi

I also have a 1 bed apartment in Qpoint - paid 25%, they have sent me
termination notice, however i can see no construction on my bldg -
020.
They have sent out new repayment schedules which say you only pay 30%
until construction starts, and then a further 10% when 30% of bldg is
completed.
Unfortunately it doesnt help if you cant get finance.
They have also not given me any assurance on completion.

Hi paul,

I am also fixed in same situation. I paid 40 % so far and i have 2 appt's (2 bedroom) in bldg no 071. They are sending monthly updates and there is slight progress on site. Recently they have changed the payment plan from 70-30 to 90-100 , plus i received a friendly reminder for a payment of 10% due on Oct-09 which has made life more difficult and unfortunately they are not listening to any of my request . Lets work out something to tackle out this menace.

I have also 2 bed each two units in QPoint. R-008 and R-072. I have paid 25% and 35%. I have received final legal notices and now waiting for RERA notice of termination as I suppose they will forfeit deposit after Rera approval. Kindly let me know if I am right. I don't know if Mazaya can forfeit without Rera Approval. I suggest we all should appeal to RERA. Kindly try to find other QPoint investors so the we can meet sometimes. I have paid 35% on one bed apt in Queue point. My building is No 19. The developer have not asked for more pmt yet as the building construction has not started yet. I think the queue point buildings progress on the computer shows that the developer will complete the whole project within 18 months. That is bad news because we will have to make payments. And personally I don't feel like putting even a penny more on the project. As what I see is that in future once I have paid the full amount the market will be lower than the balance 65% payable. Now what Hydra developer have done is that they will build less buildings than they planned initially which are sold and like if u have couple of units or u and your friend have it you and accumlate like 3 people for one apt with 35% each paid than you 3 will get one apartment and u don't have to make any more payments. This way developer also do not have to build too many buildings and there cash flow is better handled also. The developer will also attract that unit sold to customer at higher OP which otherwise will forfeit the paid amount anyway. 
Does anyone know the market price of Queue point apartment?

The market value of QPoint apartment is 400.- that is available for sale but there is no buyers at this price. You are very right and I also think QPoint price will decline when so many buildings will be made. I have two apartments each 2 bedroom. I have tried my best to consolidate into one apartment but Mazaya are so strict that they do not agree. They have sent me notices of termination and forfeiture. I am sure there is no point is paying any penny to them. The only choice is that we all should write jointly to RERA.

Dear Muhammad,

Well the procedure say they can seek for cancellation through RERA. The other way in my opinion is to ask for some time extension by making request to the developer and a copy to RERA . The impartiality  of RERA is no more they are now part and parcel of every developer for their benefit's. Gathering investors is not a problem , but do u think it can part of the solution?. I am ready to be part of any group for this purpose .

I have two units (2 Bed) mazaya is not willing to consolidate into one unit. I am not going to pay any single penny more to them. I alread paid 25% and 35% the situation of real estate market seems very bad into 2010. And may be Liwan area prices touch AED 300.- per sqft or even less. There may be same price for building and sand.

I want to know the procedure of termination contract. They have already written to Rera or they will write to Rera for getting permission to forfeit the deposit. Now, will RERA give   me a notice? What type of notice it is? Is it a notice of payment ? I have to approach Rera in writing- an appeal or I should engage a Lawyer to  prepare a letter to Rera.

I approached Mazaya to consolidate two units into one but they refused.

I have only paid 25% - Have already recieved my official termination -
not much too do other than sit and wait!
It is of course in all parties interest to continue negotiations with
Mazaya, however at the end of the day our investment is worth 50% less
and Mazaya has 52 bldgs to build - even renting them out if / when
they are finished will be very difficult - rents in Dubai are very
cheap and plenty now!

It is also impossible to get finance now and who wants to put cash
into something that will be worth 50% less for a long time into the
future?

I would suggest that the Mazaya investors on this forum could all get
together and maybe discuss a plan of action?
I will try and phone u after the Eid!

Thanks for updating the group with the good news. Have you been paid
or payment successfully enforced for this or the other cases you won?

People I have talked to in this group do not know of anyone who has
confirmed payments so it would be great for all of us if you could
confirm if you were paid.

I am trying out the judiciary system with a court case in the local
Dubai court that is still going on for over a year and will post my
experience once I get the results.

I am suing a company called RKM Real Estate which is owned by one of
the Dubai rulers and also their partner/manager called Best Homes
Emirates.
