The amount of swirl on this issue is substantial and, as near as I can
tell, completely unnecessary.

I would like to propose a declaration of intent that will make clear
that we will form a non-profit.

That will, hopefully, assuage people's concerns and make explicit our goals.

Good call.

Another option: we declare DataPortability will be non-profit, and we
will strive to create a non-profit entity if the findings of the legal
entity task force suggest this is the best way forward (as perhaps, we
choose to go for a parent organisation)

As long as we make clear that there is no intention among the steering group to be a profit-generating organization.  I am just so sick of that conversation.

The only person who keeps raising the issue is Aaron - who seems to like to keep raising issues that don't exist.

My point is just that, since we all seem to be in agreement about this anyway, let's just go on the record about it.  It's not like there is anyone proposing that we become a profitable organization.

Let's just take an official position that we intend to form a non-profit so that we don't have to hear about it anymore.

100% agreed. DP is a not for profit entity.

How we get from here to there is another question entirely – one that
I would be happy to re-open as a taskforce.

Agree 100% re: non-profit. Anything else and we may be looked at as a
potential competitor or inhibit participation due to perceived (or
actual) conflict of interest. This should be on the agenda for Monday
– and, following a confirming motion, we should instruct the
governance committee to proceed accordingly.
