They're trolling everybody in the country. No lawsuit has yet been filed, so I'd recommend just ignoring them. I presume plaintiff's attorney either doesn't know about our waiver or intends to find some way to invalidate it, which should be a tough argument in California given that our waiver is built on California case law and precedent.

A defense can run $100,000 to get it thrown out without an award to the plaintiff, and we typically don't get to recover legal expenses from plaintiffs. If you wonder why insurance costs have gone up, and legal fees, it's a string of attacks like this that are the answer.

Just to be clear, the people who are calling aren't looking for an impartial
expert--they want someone who will testify that both the other pilot and
Torrey Pines Glider Port were wildly negligent and at fault in causing or
letting this accident happen.

That could work, but you will also need to prepare an expert report, take a
deposition, and do other pre-trial work before you get to trial.  If you
change your testimony at trial, you could conceivably be convicted of
perjury.

Well, you could tell the truth in your expert report, deposition, etc, but tell them that you had said what they wanted, and they might never actually read it, especially if you started out with some rambling philippic.
