Thanks,
Alan.
Yes. For P96, it was commercial, i.e. in case you've been selling a
graphics card using P96, you had to buy a licence. I'm not sure whether
the authors are still around, I haven't heard from Tobias Abt for years,
actually, and I don't know whether he cares for P96 anymore. Probably
not. I do not know about CGFX and their licencing model.

What about for those who aren't selling graphics card and want to write free
drivers ?
Alan.
Maybe you could try to contact Toni Wilen, current maintainer of WinUAE. In
the latest round of beta versions, he is currently working on P96 related
issues, and I believe he has obtained the SDK.
Please take a look at this thread:

The problem is *not* actually getting the SDK. However, I'm unwilling to
pass out code without asking the author first. The latest email I have is
tabt at studbox dot uni-stuttgart dot de
and heck, I *am* actually in Stuttgart, but I doubt Tobias is still
around here. You could try to drop off an email. Possibly, you could ask
Olsen, maybe he knows the latest contact of Tobias.

While we're on the subject, in what form was P96 supplied
with the boards? My Picasso IV board failed a few months
ago and after getting it repaired, it doesn't work quite
correctly. The repair person suggested reinstalling P96
but I don't know where I could have put the original
medium and don't know where to start looking.

I downloaded mine from the Aminet as the software the board
came originally with was different (this was a GVP Spectrum board).
The P96 distribution(!) was available for free, just the SDK wasn't.
