Even those who serve their country, have had their kids removed from them
for no just cause or become Defrauded Veterans, who paid the high price for
defending their country.

Military dads fall victim
to child-related injustices
Laws granting deployed soldiers special protections against civil legal
actions date back to the Civil War, but few of these protections extend to
family courts and family law. As a result, military men's service to their
country often creates the conditions under which they can become victims of
injustices.
Military service costs some men their children. The federal Uniform Child
Custody Jurisdiction and Enforcement Act provides that if a parent moves a
child to a new state, that state becomes the child's presumptive residence
after only six months. Because a normal military deployment is six months or
longer, if a military wife moves to another state while her husband is
deployed, by the time the husband returns the child's residence has been
switched and the wife is virtually certain to gain custody through the
divorce proceedings in that new state.
The restrictions on military personnel's ability to travel, the high cost
of legal representation and the financial hardships created by child and
spousal support obligations make it difficult for returning service
personnel to fight for their parental rights in another state. Many struggle
even to see their children, much less remain a meaningful part of their
lives.
To solve the problem, the federal Soldiers' and Sailors' Civil Relief Act
of 1940 must be amended to prohibit the spouses of active-duty military
personnel from permanently moving children to another state without the
permission of the active-duty spouse or of a court. In addition, the UCCJEA
should be modified to state that the presumption of new residence does not
apply if the children are taken in this fashion.

Normally, when an obligor loses his job or suffers a pay cut he can go to
court and request a reduction. But since reservists are sometimes mobilized
with as little as one day's notice, few are able to obtain modifications
before they leave. They can't get relief when they return home because the
Bradley Amendment prevents judges from retroactively forgiving support.
The solution is legislation like Missouri's, which requires an automatic
adjustment of support for reservists when they are called up for active
duty.
Navy veteran Taron James, who has joined 600 other victimized veterans to
form Veterans Fighting Paternity Fraud, believes these injustices constitute
a breach of faith.
"When soldiers go off to serve they shouldn't have to worry about being
taken advantage of while they're absent," he says. "Some of the guys making
sacrifices abroad while being put through the ringer here at home must be
wondering why they bothered."

Gulf troops' babies 'are 50pc more vulnerable'

Babies whose fathers served in the first Gulf war are 50 per cent more
likely to have physical abnormalities than those born to soldiers not sent
to the region, according to a study published today.
Increased risks of genital, urinary and renal abnormalities and deformed
limbs, bones and muscles were found in the Ministry of Defence-funded
survey.
Of 13,191 pregnancies among the partners of male Gulf veterans, 686, or 5.2
per cent, had some form of physical abnormality, compared with 342, or 3.5
per cent, of the 9,758 non-Gulf pregnancies.
Miscarriages were also 40 per cent more common in the pregnancies of wives
and partners of male veterans deployed in the conflict.
Female veterans were found to have no increased risk of suffering
miscarriages.
The six-year study, published in the International Journal of Epidemiology,
found no strong link between service in the Gulf and chromosome, heart and
nervous system damage in the offspring of veterans or of stillbirths.
Dr Pat Doyle, the epidemiologist at the London School of Hygiene and
Tropical Medicine who led the study, called for close monitoring of babies
born to British troops sent to Iraq last year.
Malcolm Hooper, the emeritus professor of medicinal chemistry at Sunderland
University and an adviser to the veterans, said: "The findings will be very
worrying for them.
"I strongly endorse the call for further studies on those who served in Gulf
war two.
"There are grave concerns and significant anecdotal evidence about the
inability to sustain normal pregnancies as a result of Gulf service."
Dr Doyle said the study was important, but warned against reading too much
into the findings. "I believe our findings on renal problems and
miscarriages are important and need to be investigated in greater detail,"
she said.
She added that although "associations were found between fathers' service in
the Gulf war and increased risk of miscarriage and other malformations", the
findings should be interpreted cautiously because of recall bias, the
potential uncertainty of results based on people's memories.
Terry English, of the Royal British Legion, said: "Anecdotal evidence from
veterans has suggested a greater rate of miscarriage and this appears to be
the first scientific evidence that confirms this."
Of 53,000 British troops sent to the first Gulf war, about 630 have died and
almost 6,000 have claimed war pensions.
A range of causes for the illnesses have been suggested including depleted
uranium fallout from munitions, vaccinations administered and tablets taken
before the conflict.
An MoD spokesman said: "It is important to note the researchers have
cautioned that the findings may be susceptible to recall bias, and that it
is a comparison with a control group in which miscarriage may have been
under reported.
"Independent researchers and the military medicine health advisory group of
the Medical Research Council have said that overall there is a lack of
evidence to link reproductive health problems to service in the Gulf."
Mandy Duncan, from Clackmannanshire, has had three children since her
husband Kenny returned from the Gulf. Kenneth, nine, was born with deformed
ears, constant headaches and needs special shoes.
Andrew, eight, wets his bed and has asthma. Heather, six, is partially deaf
and suffers bowel and bladder problems.
Mrs Duncan said last night: "I don't need a study to tell me my kids have
been affected by Kenny's Gulf service. I want to know what the Government is
going to do about it."
Courts, Laws Allow Military Fathers to Be Stripped of Their Children While
They Serve Overseas
When Gary, a US Navy SEAL, was deployed in Afghanistan as part of Operation
Enduring Freedom in the wake of the terrorist attacks on the World Trade
Center, he never dreamed that his service to his country would cost him his
little son.
Under the UCCJEA, if a person takes a child to a new state, that new state
becomes the child's residence if the stay-away is for six months. As a
result, military wives who want to divorce their husbands and gain sole
custody of their children often move to another state shortly after their
husbands are deployed. By the time the father returns, the child's residence
has been switched and it is often difficult for him to even see his
children, much less remain a meaningful part of their lives.

was fraudulently identified as the father of a newborn son. Despite earning

Defrauded Veterans Have Mixed Emotions on Veterans Day

For Torrance photographer Taron James, a decorated veteran of Operation
Northern Watch, Veterans Day always brings mixed emotions. James enlisted in
the Navy at age 20 in the days leading up to the first Persian Gulf War, and
carried out hazardous reconnaissance missions behind Iraqi lines in the
war's aftermath. He earned four service medals and three ribbons before his
honorable discharge in 1994. Yet his reward for his service has been nine
years of unremitting government harassment, financial deprivation, and a
constant struggle to stay out of jail.
"Sometimes it's hard to feel much pride on Veterans Day," he says.
"Sometimes I just feel like a sucker. Veterans Day only reminds me that my
government holds me and other vets in such contempt that it cannot lift a
finger to stop a blatant fraud which victimizes tens of thousands of
servicemen. Worse, the government actively enforces that fraud."
While serving in Iraq, James was notified that a woman he knew back home was
demanding that he pay child support for her newborn son. James knew from the
beginning that the child could not possibly be his. The Navy's Judge
Advocate General is not authorized to handle a serviceman's legal problems
outside of the military justice system, but a sympathetic captain helped him
obtain an agreement from the child's mother for a DNA test.
Before the test could be done, however, the mother reneged on the agreement
and disappeared with the child. James requested a blood test from the Los
Angeles County District Attorney's office, and was told repeatedly over the
next year and a half that he would be notified when there was a new
development in the case. The D.A. instead went to court without James'
knowledge and obtained a default judgment against him. James did not find
out about it until the D.A. seized his driver's license and began taking 50
percent of his take home pay.
Despite subsequent legal appeals and an April, 2001 DNA test which confirmed
that the child is not his, the courts have refused to set aside the
judgment. In the years since the D.A. and later Los Angeles County Child
Support Services have: seized James' tax refund for six years in a row;
blocked him from renewing his notary public license, which in turn caused
him to lose his job as the manager of a business; ruined his credit, denying
him the chance to purchase the business at a low price when the owner
offered it to him for sale; blocked him from obtaining a passport; and
forced him to drop out of college before finishing his degree. James'
problem is not uncommon. According to Carnell Smith, Executive Director of
the National Family Justice Association, military men such as James are
often "preyed upon" by unscrupulous "father shoppers" who can make
fraudulent paternity designations without penalty. "The military provides (a

enacted in Illinois, Georgia, Maryland, Ohio and other states. This
legislation allows putative fathers more time and greater judicial
flexibility in challenging paternity findings.
Similar legislation in California was vetoed last fall by Gov. Gray Davis,
and a revised paternity fraud bill, SB 1030, passed the Senate 34-2 in June
but is currently stalled in the Assembly. James has joined with 600 other
victimized veterans and their families to form the Los Angeles-based
activist group Veterans Fighting Paternity Fraud.
"The problems we face wouldn't be hard for the government to solve if
someone gave a damn," he says. "Every Veterans Day and Memorial Day I think
the same thing -- we don't need parades and speeches -- we need justice."

Americans have the most ultra-expensive military in history and are
still having a tough go in Iraq. Why did Bush decide to pull troops out
