EDMONTON - The Alberta government has appealed a controversial
provincial court decision that ruled Alberta's Languages Act
unconstitutional.
The province is appealing the decision because it believes the judge
made a legal error, according to a press release issued this
afternoon.
On July 2, Provincial Court Judge Leo Wenden quashed a $54 traffic
ticket given to an Alberta francophone because the ticket was written
in English. In a complicated decision, Wenden ruled Gilles Caron's
constitutional rights were breached, and declared him not guilty of
the offence.
The decision made headlines earlier this month because a similar case
in Manitoba two decades ago ultimately forced that province to
recognize French-language rights in Manitoba's legislature, laws and
court. Advocates in Alberta hope the decision marks the first step
towards a similar shift in Alberta.
The Alberta government said it is seeking "legal certainty and
clarity" from the court because the decision has "significant
ramifications" for the province's laws.
A date for the appeal hearing has not yet been set.

I agree.
There are two sides to a debate on whether Alberta should
print tickets in both English and French (two national
official langauges vs more people in Alberta who speak
Ukrainian, Cantonese and Mandarin than speak French).
But a subject line that drips with Peffers brand of racism
doesn't open the topic up to debate.
