BYUARC closing social/barbecue

Hi all,

The end of the year has come already, and that means it's time for our closing social! We will be meeting this Wednesday evening at Becky's house in Orem (420 South 1000 East). The festivities will likely begin at 6pm, but that may still change by an hour or so. More information will be forthcoming about that and about what to bring food-wise. Definitely plan to bring a radio if you have access to one. For those who have checked out a book or anything else from the club, please plan to return it at that time as well. Those who took thank-you letter-writing folders can turn in completed letters (with the folder, printed letter, and any extra stationery) to the social as well.

Also, a very important part of the closing social will be the election of new club officers. Those of you who cannot make it but would like to run for a particular position should notify me via e-mail by 3pm Wednesday. Please note that only dues-paid student members of the club can vote or run for a position. (If you haven't paid your dues yet, you can do so online at the BYU Clubs website). 

Finally, as many of you may know today (Tuesday) at 10:15am Utah is running a state wide earthquake drill called the Utah Shakeout. We did not get involved with this as a club, but the local UCARES group that joined us for the Rex Lee Run has signed up. It may be too late, but if you would like to try and participate somehow, you can e-mail Suzanne Barney at k1...@ucares.org. Details on the Shakeout, along with other ways you can participate, can be found at http://www.shakeout.org/utah/ .

USA today has a rather nice article, in its tech section, today that
addresses the issue of home owners associations and there attempt to
stop people from putting up antenna. The telecommunications act of 1996
says that HOA can't stop you, with a few limits.
Even for renters.

It is worth a read.

I haven't read the referenced document in full yet, but the rules they
cite apply to TV reception antennas, not ham radio. It's possible the
document covers ham radio as well, but make sure you read it before
you assume it does.

Actually, reading down through the page:

Q: I want to install an antenna for broadcast radio or amateur radio.
Does the rule apply to me?
A: No. The rule does not apply to antennas used for AM/FM radio,
amateur ("ham") radio (see 47 C.F.R. §97.15), Citizen's Band ("CB")
radio or Digital Audio Radio Services ("DARS").

OTARD does /NOT/ apply to ham radio.

The relevant statute appears to be the 47 CFR 97.15 cited in the answer.

PART 97: AMATEUR RADIO SERVICE

Subpart A: General Provisions

97.15 - Station antenna structures.

(a) Owners of certain antenna structures more than 60.96 meters (200
feet) above ground level at the site or located near or at a public
use airport must notify the Federal Aviation Administration and
register with the Commission as required by part 17 of this chapter.

(b) Except as otherwise provided herein, a station antenna structure
may be erected at heights and dimensions sufficient to accommodate
amateur service communications. (State and local regulation of a
station antenna structure must not preclude amateur service
communications. Rather, it must reasonably accommodate such
communications and must constitute the minimum practicable regulation
to accomplish the state or local authority's legitimate purpose. See
PRB-1, 101 FCC 2d 952 (1985) for details.)

Sorry. I thought I read the whole page. I did not see that.
Oh well live and learn.
Now where is that antenna tuner so I can use my tv antenna for 2m when I
am not watching tv.

It is called the OTARD rule. It does apply to ham and wireless internet as
well as TV.

It appears that OTARD does NOT NEED to apply to amateur radio because 47 CFR 97.15 (b) ALREADY ALLOWS ham radio antennas and their support structures even in HOA-restrictive conditions (note the wording of paragraph (b): "State and local regulation of a station antenna structure must not preclude amateur service communications. Rather, it must reasonably accommodate such communications and must constitute the minimum practicable regulation to accomplish the state or local authority's legitimate purpose."). The words "MUST NOT PRECLUDE" and "MUST REASONABLY ACCOMMODATE" seem pretty clear to me.

Rather, it should be apparent that our responsibility as good ham radio citizens is not to flaunt our right to erect antenna structures in spite of restrictive covenants, but rather to work with the HOA, pointing out the federal regulations and the value of amateur radio communications services, in an effort to achieve a compromise, or better yet, a change of the HOA restrictive covenants, that will allow us to erect a reasonable structure/antenna which will accommodate our communications needs (not just our hobby and rag-chewing, but also our public service and emergency communications), yet not be a significantly unsightly or dangerous blight on the neighborhood. After all, HOA's exist to mutually protect and preserve the safety and value of the neighborhoods they serve. That is a function worth respecting.

Well put, Jim. I think that sums it up perfectly. Personally, when I
get a home, I'm hoping to get one unencumbered by an HOA, and outside
city limits so I have more room for antennas. But we all have to make
the best of our circumstances. :)

Greetings all
This next Tuesday (5/8/12) at 7:00PM a couple of us are going to get
together to document the coax between the shack and the penthouse( where
the coax heads for the roof).
It should not take to long, there are only 3-4 that we don't know just
which is which.
