Our lawyer pleaded that pensioner are getting  BP +DA.  It should have been that pensioners are getting  BP(at the time of retirement) and DA. Basic pay is not enhanced by every pay revision.

The judge claims that he has understood the issue.
But uses the word 'increments' instead of pension updation.

This was expected tactic of IBA/PNB to get the case prolonged. However the tone of the judges seem to be in favour of the pensioners.
Let us hope for the best.

In the hearing for the Late M C Singla vs. Union of India case (CA 7993/2023) held today, February 25, 2026, the matter remained part-heard and was adjourned to March 12, 2026.

Key outcomes from today's session in the Supreme Court of India (Court No. 2) included:

Evidence Submission: Pension calculation charts submitted by the petitioners and the Indian Banks' Association (IBA) were taken on record.

Arguments: The petitioners' counsel highlighted that basic pensions have remained stagnant for years, while the IBA's documents were scrutinized regarding the financial impact of potential updations.
PNB Adjournment Request: The counsel for Punjab National Bank (PNB) requested more time to study the newly submitted material and argue their side, which the court granted.

Judicial Observation: Justices Vikram Nath and Sandeep Mehta reportedly observed that banks are liable to pay pensions as per the Bank Employees Pension Regulations, 1995.

The judge seems to have acknowledged the fact that pension need improvement. Judge repeatedly asking Bank advocates 'what are you paying other than DA".
So far 2 favourite slogans of IBA  Absence of updation in pension regulations and huge cost is not the subject matter of discussion before court.
Bank advocate has got opportunity to present his case on 11thMarch. Then he may bring up these arguments and  will try to convince judges.

AI's update:

February 25, 2026 Hearing Highlights

  • Part-Heard Status: The case has officially reached the stage of final arguments and is now designated as "Part-Heard". This means the court has begun a deep dive into the merits and will continue from this point in the next session.
  • Judicial Observation: During the proceedings, the Bench (Justices Vikram Nath and Sandeep Mehta) reportedly observed in open court that "Banks are liable to pay the pension as per the pension Regulations". This signals a potentially favourable lean toward the petitioners' legal rights.
  • Next Hearing: The matter has been fixed for the next hearing on March 12, 2026.

Documents Filed and Under Review

The court is currently scrutinising specific data to cut through the IBA’s claims of "financial burden":

  • Pension Entitlement Charts: Following previous court directions, the petitioners have filed detailed charts showing pension entitlements across three critical eras: Pre-19871987–2003, and Post-2003.
  • PNB's Submission: Punjab National Bank (PNB) filed its own pension paid charts, though retirees' advocates pointed out that these charts showed basic pensions remained unchanged, only including "Ex Gratia" payments added in 2022.
  • IBA's Stand: The IBA filed a 118-page document, which some observers describe as a repetition of their previous affidavits, potentially aimed at further delaying the updation process.
  • Joint Note: PNB has also sought to bring on record a "Joint Note" related to the 12th Bipartite Settlement as additional evidence.

If the judges have come to the conclusion that the Singla ji case for pension updation has no merit they coul have dismissed our case in first hearing itself.
The judges have understood that there is strong need and the demand of pension updation is justified and the UFBU and IBA combine have deliberately created by saying
1.There is no provision for pension updation.
2. It is subjudic to negotiate.
3.The  cost factor.
All the three reasons cited by IBA and where is paisa slogan raised by the leader are baseless and a deliberate attempt to deny, discriminate and an affront on the dignity of pensioners and a big assault on  the justice. We shall get favourable verdict and Sri Singlaji will rejoice the judicial victory and all advocated who support IBA and UFBU combine wrong and misleading interpretation will regret for their blindness.

The judges have understood that there is injustice perpetually forced on pensioners with ill will.
That is why the judges have saught three time slots pension payments charts to find out whether the pensioners are paid same pension for same service and same position
If not it should be paid irrespective of retirement indefferent bipartite settlement.
Justice shall prevail and we will get favourable verdict.

The question is will Pensioners side lawyer be able to strongly convince Hon.Judge that for pension updation there is no need for provision for updation in pension regulations. Citing multiple updation in RBI though there is no provision for pension updation in their pension rules. Regulations can be amended later on.
Further Hon. Judge has given permission to parties to file additional documents. Pensioners should provide the detailed calculation chart of Updation applying the RBI formula.
IF IBA cites huge cost pensioners' side should demand that IBA provide details of actual cost of updation and provision separately, bankwise so that iBA cannot quote some imaginary figure.
Dhryv Mehta and his brother Tushar Mehta are most influential advocates.
They are sure to come up with fresh dara and stronger attacks on 12th March.
So far Pensioners side advocates have done some food job, but not much impressive. They need to have clarity on what formula of updation they want.

The judges have called for pension paid in three  different time slots.
The pension updation as per 35/1 and appendix 1 shall be updated and accordingly the pension has to be revised..
As our pension regulations are based on RBI and central government pension scheme the updation case can also take place to have uniform pension updation in banking sector.
In all posbilities the updation
Will take place as per RBI formula to have equity and fair play and on the principles of Natural justice and to put an end decades old issue.
