The 100% d a issue was a grave injustice and a serious discrimination to
pre nov 2002 retirees, rather than its monetary aspects . Of course money
too counts. Except, few people like chv, etc the present ufbu leadership
are not responsible for that treachery. Let us thank the present ufbu for
achieving this. There were many stalwarts, like B .Ramji, C.R.
Chandrasekhar etc who took lead in fighting this issue. Unfortunately
man y of them left the world, before achieving this. I know in few cases,
both the pensioner as well as the spouse departed and in such cases, who
will enjoy this achievement.

who has completed 20 years service as per section 29(5) of Pension
Regulation Act. It was allowed to VRS Retirees of all Nationalised Banks,

Union of India : Matter was briefly heard .Govt / Bank wanted 8 weeks as it
wanted to refer the issue to IBA which was opposed by our Advocates that
our issue is SBI specific and nothing to do with IBA . SBI pension scheme
is statutory and validity of amendments has to be examined by the court and
no committee can decide or dictate. However ,court directed the Govt to
hear the petitioners in third week of August 23 and submit the report to
court subsequently, Court once again reiterated that final decision would
be taken by the court after testing the views on constitutional

We are enclosing a copy of the letter by our Apex Organisation, All India Retired Bank Employees' Association thanking UFBU not only for extension of 100% DA nutralisation, also for ensuring all Pre-2002 pensioners, irrespective of their Basic Pension, get some increase.
Many of us were complaining and blaming UFBU, by making it responsible for non-introduction of UFBU. When we blame them for non-extension of any benefit, we should be generous enough to acknowledge their efforts, when benefit is extended. It is pertinant to point out that in Reserve Bank of India, nothing was paid to those who were getting pension with 100% DA. But, Ex-gratia for them is also introduced and all pensioners and family pensioners who are already enjoying 100% DA would also get some increase. Definately, UFBU should be commended for this.
We are also happy because this benefit is out of an agreement. Therefore, this benefit cannot be taken back. I am extracting a portion from the Judgment of Hon'ble Supreme Court, wherein payment of pension itself was withdrawn.

95. Our determination, with reference to all the issues canvassed above, would also answer the question left open in para 73 above. Namely, whether or not the contingent right, as was vested in the respondent employees, was binding or irrevocable. We may now sum up the position determined by us, in the foregoing paragraphs. It is no doubt true that we have concluded that the 1999 Scheme, created a contingent right in the respondent employees. The respondent employees comprise of all those employees of corporate bodies, who had opted for the 1999 Scheme, immediately on its having been introduced; all those, who were deemed to have opted for the 1999 Scheme by not having exercised any option; and all those who were appointed after the introduction of the 1999 Scheme. The first issue that arises is, whether any express right or obligation existed between the respondent employees and the State Government. One can understand such a claim arising out of an obligation between an employer and his employees, where there is a quid pro quo — a trade-off based on a relationship (as between, an employer and employee). We have, however, concluded that there was no such relationship between the State Government, and the respondent employees. All the corporate bodies in which the respondent employees were/are engaged, are independent juristic entities. It is, therefore, apparent that the claim raised by the respondent employees, is not based on any right or obligation between the parties. We have also examined the submissions advanced by the learned counsel premised on various constitutional provisions (Articles 14, 16, 21 and 300-A of the Constitution of India), but have found that no right can be stated to have been violated thereunder. We have also examined the other legal submissions, advanced on behalf of the respondent employees, and have found the same, as unjustified. The issue whether administrative review was permissible after the 1999 Scheme had become operational, has been answered in the affirmative. And finally, we have concluded, that the exercise of such power, while issuing the repeal notification, was based on due consideration. We, therefore, hereby uphold, the legality and constitutionality of the Notification dated 2-12-2004.

Comrade,
We are constrained to place on record the casual way the issues are being
handled by UFBU under present leadership.
Though, the list is long, we restrict ourselves on the following points.
2. Our organisation gave the strike notice for 2 days in March 2022,
projecting our demands on Industry, on unresolved residual issues and
extending solidarity actions with Central trade unions for the two days
strike.
On the directions of the Labour authorities on residual issues, discussions
were held by IBA.
It was AIBOA, which did the job required to break the impasse. Then, gates
were opened for officers’ Union and workmen unions separately for couple of
rounds of discussions.
3. In this year too, once again two days strike call was given by UFBU,
focusing three main issues :
A) 5 days week,
B) Up dation Pension and C) commencement of wage talks along with other
pending issues.
The strikes were averted in the background of commencement of the talks by
IBA.
On 31st Jan, 2023 and 28th February 2023 two rounds of discussions were
held.
A commitment was obtained from the workmen side that IBA will write to the
Government with the commencement of working of the banks from 09.50 am to
5.30 pm.
In the event, if DFS insists for additional 5 minutes extra with the
consent of workmen leaders, they may approach DFS for their concurrence.
But best reasons unknown to us, you were not present on 28.02.2023.
Even to come out with a circular it took nearly
7 days giving rise to very many question.
It is nearing 5 months completion, the issue is finding no focus in the
discussion held recently in successive rounds.
More than the money compensation, work-force requires work-life balance.
When LIC unions could achieve it from 15th April 2021 why not us till date?
4. Insurance backed Hospitalisation Scheme :
On IBA suggesting that the representatives of three unions
(AIBOC, NCBE AND AIBEA))
would constitute the small committee with specific reference to the costing
exercise by capping the item wise expenses, it was categorically placed
that the meeting of all representatives should be held with IBA as that of
Profit Linked Incentive meeting conducted earlier on our collective
submissions to you in the meeting held at New Delhi in your Parliament
Street Bank branch -Board room on 11th September 2019.
FUNCTIONING OF UFBU UNDER YOUR CONVENORSHIP.
a) Though it was pointed out by two constituents, in the meeting held at
Mumbai at Hotel Avion you turned down our submissions, for the best reasons
known to couple of representatives.
Other constituents have been kept under dark.
Ultimately, the suggestions made in the meeting was implemented by IBA.
On 21.06.2023 all the unions (9 + 1) who were party to the 25.05.2015 and
11.11.2020 were invited to participate except us, purely taking shelter of
veiled threat let loose by one of the constituents.
First time, UFBU had taken the role of the management to deny the entry to
AIBOA elected representative, without informing the expressions/decisions
of the other constituents from the meeting held on 21st June 2023 at IBA
Office.
We conducted ourselves as a responsible organisation not to be an
impediment to you. But knowing well the stand of AIBOA, you did not
restrict/deny the entry to an officer purported to have representative
character in IBA on 21st June 2023.
It was given to understand that he signed the attendance sheet and remained
in the meeting. One of constituents of UFBU wanted it purposely to happen.
b) We wrote to you in detail on 02.07.2023, 12.07.2023 and also 20.07.2023
in connection with the denial of representatives to participate in the
discussion after the court case filed by the two individuals in Dwarka, New
Delhi.
The operative portion was quoted clearly in the letter, expecting you to
respond making your stand candid and clear to us.
As usual, you remained non communicative to AIBOA.
c) Once again you had only forwarded the letter to constituents including
AIBOA, enclosing the IBA letter dated 21st July 2023 addressed to you with
your covering letter dated 24th July 2023. In turn we have provided the
name of the representative for participation in the discussions.
d) On 28th July 2023, in the IBA office, in spite of our convincing and
cogent assurance to you by Com. Alok Khare Chairman AIBOA and the
undersigned, you negated our participation based on the manufactured
document.
e) On our taking up the matter with the IBA authorities in person on the
same day, it was reported that it was
UFBU which had restricted our participation in the discussions held on
three occasions.
Our organisation would like to know from where, as a convenor, you have
drawn the authority to deny our organisational participation.
If any provisions of conduct rules for UFBU enacted and adopted by you in
your tenure for the past seven years, will you please make it available to
all the constituents immediately on receipt of this communication.
f) In addition to the above, why you were hesitant to provide the prepared
documents of understandings of few constituents arrived at behind the back
of the other constituents. Leave alone one up man ship, but why not the
same is discussed in the UFBU meeting prior to signing the same to
understand the contents, pros and cons of signing such a document in the
matter of Hospitalisation scheme applicable to all banks other than SBI.
Strangely enough, trade unions are expected to retain the facility
achieved, if not improvement clinched. Reduction of coverage to the senior
citizens, when Right to Health is the subject matter of the Nation and
constituents were made to sign the retrograde scheme delinking the retirees
from the serving employees contrary to
the first understandings signed on 25.05.2015. Absolutely an adverse step
by UFBU.
5. UP-DATING PENSION HAS BEEN SEALED ONCE AND FOR ALL:
While correction of the mistake by introducing two sets of D.A.
compensation ie prior to 01.05.2005 and after that 100% DA neutralisation
committed by unions on 02.06.2005, the same was struck down by supreme
court in March 2018. Please refer the circular issued by IBA in this regard.
Though we may claim it is baby step for success from roof top, surely it
shuts the doors of up dation of Pension to all by government notification,
as available to RBI / NABARD from 1.1.1986 till 1.11.2017 in the near future
In fitness of things, to enable to understand the approach pursued by you
as UFBU convenor in dealing with men and matters, we request you to
communicate your response and also provide the copy of the Codes drafted by
you if any and convene a full -fledged meeting of the UFBU authorised
representatives of three from the constituents for the betterment of the
workforce presently in the banks.

As per direction of High Court of Delhi,dt.13th April'23, in case No.
W.P.(C) 1875/2013 filed by Federation of State Bank of India, and Ors
versus The Union of India and Ors, an expert committee was to be
constituted by the Ministry of Finance to examine the grievances of the
State Bank of India pensioners, consisting of officials from.DFS. and IBA.
As per court, if above Committee find any merit in the grievances,
appropriate action be taken before the next date of hearing, which is
listed for 31st July 2023.
As far as PSB pensioners are concerned apart from specific issues of SBI
pensioners the following major issue related to all pensioners is also
included in court direction.

revision/settlement;”*
*( Meanwhile another issue included there on of extending 100% DR to pre
Nov 2002 pensioners have already been resolved by IBA-UFBU on 28th July

Therefore the report of Committee to be submitted to High Court on or
before 31st July ’23, has much significance, to all bank pensioners.

today.

BMS CENTRAL LEADERSHIP MET FINANCE MINISTER ON IMPORTANT ISSUES OF BANKMEN
PENDING SINCE LONG:
A Central Delegation of Bharatiya Mazdoor Sangh, led by All India President
Shri H.J. Pandya, Sri Girish Arya, All India Secretary & In-charge of
Financial Sector met the Finance Minister Smt. Nirmala Sitharaman at her
office on 27.7.2023 at 4.30 pm. S/Sri Mutiyalu, V.V. Raghav and Kondalrao
also accompanied the Delegation. The meeting lasted till 5.15 pm.
The purpose of the meeting of the Delegation was to attract the attention
of the Hon'ble Finance Minister towards the burning issues of the Bank
Employees and to request their early resolution. On this occasion, the
Delegation handed over the memorandum bearing No. BMS/C-2/168/2023 dated
27.7.2023 to the Hon'ble Finance Minister, in which the burning issues have
been raised point-wise, which were discussed in details.
1. PENSION UPDATION:
In the matter of Pension Revision up to 31.10.2017 on RBI line and 100% DA
to pre- November, 2002 Pensioners, the Delegation told the Hon'ble Finance
Minister that Pension in Banking came after Pension Settlement in RBI in
1990. On 29.10.1993 an agreement was signed between IBA and bank unions.
To explain the uniformity of Pension of RBI and other Banks, the Delegation
informed the Hon'ble Finance Minister that while in RBI Pension is given in
lieu of PF contribution, in other Banks also it is in lieu of CPF. Pension
in RBI came into effect from 1.1.1986, so did the same in the case of other
Banks. The basic condition of Pension was to revise the Pension with every
Pay Revision. The 5th Bipartite Settlement was done along with Pension
Settlement of 29.10.1993, which was effective from 1.11.1987, so the
Pension in RBI as well as other Banks was updated up to 31.10.1987.
Now, the Government has updated the Pension of RBI and NABARD Pensioners up
to 31.10.2017. Therefore, in compliance with the Pension Agreement dated
29.10.1993, the same should be done in the case of other Banks also.
3. PENSION OPTIONS FOR RESIGNEES AND OTHERS, IF ANY,
The delegation apprised the Hon'ble Finance Minister that there are a
handful of Resignees who were not given the option of pension. There are
some other people who have been left out. Sacked, Dismissed, Terminated,
Removed, CRS people have been given the option of pension. They all were
punished for some unseemly conduct, but pension has been awarded to them.
Resignees mentioned in the same clause are not given pension option. They
resigned due to some unavoidable family problems. They worked honestly in
the Banks. They have been denied the right to Pension without any cogent
reason. They deserve justice.
4. PENSION AND OTHER RETIREMENT BENEFITS ON SPECIAL ALLOWANCE:
In the 10th and 11th Pay Revisions, a big percentage of basic pay has been
deducted and renamed as 'Special Allowance'. This Special Allowance is
ineligible for Pension and other retirement benefits. It is in vogue at the
rate of 7.75% to 11% of Basic Pay with effect from 1.11.2012 and 16.4% of
Basic Pay with effect from 1.11.2017. Thus the Pension has been reduced
from 50% to 45.5% with effect from 1.11.2012 and 41.8% from 1.11.2017
There are several court cases pending in the High Courts and the Kerala
High Court has held it wrong.
Special allowance should be allowed for Pension and other superannuation
benefits, is our humble submission.
5. EXTREMELY IMPORTANT - REGULATION OF DAILY WAGERS:
The Delegation informed FM that around 1.5 lakh people are working on daily
wage basis for last 5 to 15 years in regular peon posts. They come from SC,
ST, OBC and most oppressed class. They are being exploited a lot, they are
not getting any benefits that regular employees get.
The delegation made a strong appeal to the Honourable Finance Minister to
kindly arrange regularization letters to these daily wage workers at the
hands of the Honourable Prime Minister. This will end the bonded labour
policy in banks. This will be a big message for the suffering and exploited
section of the society.
6. DEMANDS OF WORKING EMPLOYEES:
Referring to the problems of working bank employees, the Delegation
demanded immediate approval of 5-day banking, which has been agreed between
the Unions and IBA.
BMS has taken a holistic approach to the problems of Bank Employees,
officers and Pensioners. In the first phase, the organization has taken up
very serious and long pending cases and it will be our endeavour to be
successful in maximum cases. In next phase we shall take up other issues
including court cases which Banks/ IBA are pursuing against Bank men.

the long pending demand.
It is not out of place to remember at this time the leader 'Shri Debesh
Bhattacharya of United Banks Retirees' welfare Assn, who was the
initiator for this demand and could got it from Kolkata High Court., though
subsequently SC rejected it.
He must be satisfied now that the issue has ended with settlement
though it took a long time.

1621. SHRI RAJMOHAN UNNITHAN:
Will the Minister of FINANCE be pleased to state:
(a) whether the Government is aware that even after twenty eight years
since introduction of pension scheme in Banks, it has not been revised and
the retirees, especially those retired long back are living with great
difficulty with a meagre amount of pension if so, the details thereof;
(b) whether the Bank Retirees are not given revision in pension along with
the wage revision of serving employees on similar lines like the pension,
scheme of Central and State Government retirees;
(c) whether the Government proposes to raise/revise the pension scheme of
the bank
retirees to ensure the quantum of pension payable to pensioner is adequate
to meet
his/her basic needs and lifestyle to which he/she is accustomed to live to
achieve the
objective of social welfare;
(d) if so, the details thereof; and
(e) if not, the reasons therefor?
ANSWER
MINISTER OF STATE IN THE MINISTRY OF FINANCE (DR. BHAGWAT KARAD)
(a) to (e): Pension, a funded scheme, was introduced in nationalised banks
through Bipartite Settlement signed on 29.10.1993 (covering employees
retired on or after 1.1.1986), between unions/associations of bank
employees and the Indian Banks' Association (IBA), which negotiated on
behalf of participating banks. The Boards of the respective nationalised
banks accordingly made Employees' Pension Regulations, 1995, in exercise of
their powers under section 19 of the Banking Companies (Acquisition and
Transfer of Undertakings) Act, 1970/1980. These regulations do not have
provision for revision of pension.
However, pensioners/retirees of banks are being granted Dearness Relief on
pension and the same is being increased from time to time i.e. on half
yearly basis.
IBA has further informed that the matter of pension updation of Banks is
sub-judice in Hon'ble Supreme Court of India.

You rightly put it. Denial of 100% da to pre nov 2002 was infact a revenge
taking by thenufbu leadership on VRS optees. They did everything to deny 5
yr weightage co.mutation and granti g 50% basic pension to vrs optees. It
was only because of the court cases we wonthose things. Many stalwarts were
there and in the middle many left this world. Whatever the vrs people got
extra more than that was snatched away from them by denying this 100% da.
In fact, when one compare the retirement benefits of a present clerk, with
that of a se ior officer vrs optee , the VRS benefits were abysmally
low. Both IBA and ufbu behaved grudgingly towards the pre2002 pensioners
and only due to the intervention of FM Nirmalaji, due the the efforts of a
group of dedecated retirees, pre2002 people got belated justice.

It may please be noted that pre2002 have now been granted only that which
the other retirees have been getting since Feb2005/date of retirement.
While asking for arrears is not unreasonable, that demand will never be

Chv should try to live as a pensioner pre 2002 with no savings except pension and will know the pain, agony, and humiliation. Some of our pensioners say that we should be happy with whatever we get. Let those people keep such comments to themselves and not to preach their ideology to the whole group. This google group is not for them. We too have worked and when our PM Modiji declared one rank one pension to defence personnel, we welcomed it. Why some of our own people oppose updation. Perhaps they are chamchas.

exists for central govt Employees pension scheme too
Central Govt also has a moral responsibility as they had walked away with
sizable revenue after divestment which also has a retrogade effect on
pension Fund
The negotiating team of Union and Association supposed to represent
pensioners has done nothing for pensioners so far
In the ongoing bipartite also they have decorative post of pensioners
representatives.
Visualise hungry pensioner standing, with bated breath holding on to the
closed gates of negotiation venue where deliberations take place over a
sumpuous Lunch but nothing coming in their favour year after year

Dear Mr.Karunakaran,
Eligibility to renew IBA Group Medi Insurance Policy was restricted in
earlier years to originally enrolled retirees only.
However now there is no such restrictions and banks are allowing
retirees/family pensioners who have already covered under previous policy
and left out from renewing their policies in previous years to enroll fresh
for latest policy.
So any retiree those who wish to join in current IBA policy for 2023-24 on
payment of prescribed premium can do that.You may contact the bank branch
to proceed further once policy terms are announced.
Regarding rate of premium, some understanding has been reached on GMIS of
IBA with Unions and details of new premium rate will be known shortly
before Oct 2023.

may not be so simple.
One can observe and learn from ISRO how our Chandrayaan-3 mission to Moon
will proceed in stages and expected time of landing.
But in the matter of Updation of Pension, retirees /retirees apex
organisations do not have any idea when it will be discussed at IBA ,
rathen than implemented!
Under legal process though delayed ultimately a verdict may come either
positive or negative.
Here only certain positive indications, are before us now.One of the long
pending issues ie: 100% DR issue has been sorted out last day,benefitting
few thousands of senior/super senior citizen pensioners/family pensioners.
Now let us hope that updation of pension benefitting all pensioners /family
pensioners in banks too may be sorted out by IBA/UFBU in forthcoming wage
negotiation talks.
Some favorable aspects are: As per MOF/FM the profit of the PSBs in latest
FY is good and level of NPA has also came down.Hon.FM has also expressed in
open forums on her concern on resolving bank retirees issues (as well as
through reply in Parliament.)
We cannot also, under estimate the efforts taken by all
organisations/individuals towards, in this direction.
It will happen.

Sri.C.N.Prasad is contributing much to get benefits to the pensioners. He has worked hard to get 5 years benefit, 50% Basic pension and commutation arrears from DOR along with Sri.Palani and others and he has also succeeded in ensuring recovery of commutation from Date of credit instead of DOR. Please note that even today some PSU banks have not properly implemented SC verdict of 2018 and other two retiree's organizations have put the issue to cold storage.Unlike other major retiree organizations Prasad does not work for publicity and he is monitoring some important cases and will come out with details at appropriate term.Please have patience till then.
