``She said, `We don't need this any more. We'd like you to have this','' Mr
Kennett said.
"Honest judge, this bloke *offered* me the $23 worth of
biscuits, I didn't steal it"

But the prima facie case is clear... a painting which is not his,

I don't argue with the tim tams/paintings theory - but I doubt your
legal opinion about "no provision" in the law. I think there is
plenty of provision in the law for not convicting someone for a
non-deliberate act - but that's a matter Victorian prosecutors isn't
it? I mean not like Kennett has friends in the Victorian government
these days, so maybe it's simple lack of evidence to successfully
prosecute?
Anyway, my main point is that Kennett hasn't had a trial (not even
charged), but the original post labelled him an art thief. Even the

What is most telling, and the foundation for my comment
that by his own admission, he is a thief, is that:
He returned it, did he not?
And he acknowledged that he did not own it.
And therefore IT WAS WRONGFULLY IN HIS POSSESSION!
And it is TRUTH, not defamation to describe it as stealing,
and the man who is responsible for it, as a thief.

Ahhhh... but that's where you are WRONG. In the case of defamation you
are presumed GUILTY until you prove yourself innocent, once a
defamatory imputation is made out. It is the reverse from criminal
matters, but then I don't expect you to know anything about that, or
you wouldn't have made the silly claim!
In your case, you calling Kennet a thief, and if it went to trial it
would be up to you to PROVE the truth of that statement - as you have
called him a "criminal". A task I'm sure you are unable to to
complete.
Therefor it is QUITE correct for me to say you HAVE defamed Kennett,
as you are GUILTY until proven innocent.

It also includes inserting text in mid paragraph, taking the meaning
away. It includes inserting text in MID SENTENCE ruining the intended
meaning. It includes totally snipping PART of a sentence (without
