Dear All,

We have all been waiting eagerly for the development in Asilah to reach completion but this seems less likely in the foreseeable future. It has been almost eight years since we signed the contract and still there's a very little progress on the ground. I discussed the idea of coming up with an action plan to solve this problem and put maximum pressure on the developers to resume work on the site with some investors in the group.

We thought it would be good to call for a group meeting in London on Saturday 8th February to discuss the situation and to agree on an action plan. I am looking for a suitable venue in central London and will communicate the details in the next few days. 

Please try your best to attend the meeting so that we reach a consensus between the group as to the most effective way to move forward. There are four approaches we need to discuss and to weight their pros and cons in the meeting:

1/ Contact The Moroccan Embassy in London and request support (already started)

2/ Contact the British media and make a noise to expose the developers and make bad publicity

3/ Take a legal action against the developers and demand compensation; need to appoint a solicitor

4/ Meet with the developers, understand what the issues are and try to help them complete the apartments

I look forward to receiving your feedback on the above so that we come up with a real and effective plan.

I am looking at option 3 already and have passed the info regarding my position to a legal company who specialise in foreign property issues….

 

The company is based in England and is called Judicare.

 

I only engaged with Judicare last week.

 

I will keep you briefed on any updates.

 

I am based in Ireland and will not be in a position to attend your proposed meeting which is a good and positive idea.

I will not be able to attend the meeting but as previously advised I have already engaged Legal Property Solutions in Spain to pursue a case against the developers solicitors for negligence.

 

I am advised that the prospect of a claim against the lawyers’ Professional Indemnity insurance is good albeit progress has been slow to date.

 

There are a number of parties taking similar action

I have been trying to get in touch by phone with Larbi Bouattaf but cannot get an answer (Economic Counsellor) for Embassy of the kingdom of Morocco.  He is very much helping us with our other site in Morocco and we have been told the first phase will now be completed in 6 months they are adamant this will happen work has commenced at the meeting I was at 3 weeks ago Larbi Bouttaf advised they would see it through to the end.  I was going to e-mail him do u think we should ask him to the meeting I could say it in the e-mail but would like to know how you feel about this first.  We will come to the meeting also great idea.

I also now think we should all meet and try to get some

the moment with my wife in hospital after an accident and doubt very

Dear Caroline,

I also have been trying to reach Mr Larbi at the Moroccan Embassy. I discussed the matter with him back in September and he asked for a copy of the contract and a summary of events since 2006 which we sent already. We have been trying to contact him recently by phone/email but he never replied. It's worth inviting him to the meeting to get a better understanding of the situation and hopefully do something positive.

Okay I have an idea.  Our other site PGBR  we have a core team who liaise with Mr Larbi Bouattaf and they do meet with him and are in contact on a regular basis so I will e-mail them to ask for their help in contacting him to ask if he would attend our meeting.  It's worth a chance. I do feel it would be really beneficial to us to have him at our meeting.  Alaa do you have any idea how many will be at the meeting?

May I send our Best wishes to John and Margaret Wheeldon and wish Margaret a speedy recovery after her accident in Singapore.

I spoke to Mr. Larbi at the Moroccan Embassy regarding progress in Asilah. he said he couldn't find any useful information on the current status but he asked for the name and address of the developer. I asked Richard Sawkins who is in touch with a solicitor in Spain whether we can get the developers' details, and we are awaiting their reply. If anyone has the details of the developer, please send so that I forward to Mr. Larbi. We should pursue the embassy route first but looks like we will eventually have to take the legal route through Spanish or Moroccan solicitors.

Dear All,

just to summarise on latest updates and to exchange some information:

1/ I wrote to Mr Bouattaf at the Moroccan Embassy again and am wating for his reply.

2/ Our friend Ali got in touch with with a person who was involved in the architecture change when they introduced another floor to some blocks. The guy is very helpful and seems to have good knowledge. He believes that the developers are facing financial difficulties and it's hard to get another loan from banks. He advised that while pursuing the Embassy efforts, we put a restriction order on the deeds so that our consent is taken into account in any sale or transfer that may happen in future. This order costs about 410 Euros.I will make an enquiry to understand the process and whether it's legally binding, and let you know.

3/ The legal route, though it might force the developers to complete or refund the money, is very long, costly and may lead to nothing binding. One of us has already appointed solicitors in Spain more than a year ago but the case has made no significant progress.

4/ The proposal from Anna was to arrange a meeting with the developers in Morocco to discuss the situation and find a solution is very reasonable and may lead to a positive outcome. Those who are willing to be involved in the meeting, please let me know to set a suitable date in September.

Hi All,

We should aim for a meeting with the developers to get a better picture, and an initial consultation with a solicitor to explore the possibility of enforcing a restriction order on sale and also taking a legal action in a Moroccan court. We plan to go to Tangier tentatively on 14-16 September but this is yet to be confirmed. Let us know if you can make it on these days.

I assume the best way is to fly into Spain (No direct flight from Mcr ) and then get the ferry over to Tangier. Has any been to site in the past that can suggest local hotels etc. To use as a meeting point and stay over. I have e/mailed the developer with no reply.

Hi Steve,

We are planning to go for the period 13-16 September. This includes a weekend a working day to be able to see the site and officials/solicitors. Flights are available from Gatwick on Air Arabia or a mix of BA and Iberia from Heathrow. We are going to book from Heathrow as it's closer to home (return flight around £220 per person). We will be staying in a hotel in Tangier. Most likely El Oumnia Puerto which seems to be a nice a 4* reasonably priced hotel in town (£190 per room for 3 nights incl breakfast).

It would be great if all/most people travelling on the same dates and book in the same hotel to coordinate transport and visits in Morocco.

I discussed the matter with him back in September and he asked for a copy of the contract and a summary of events since 2006 which we sent already. We have been trying to contact him recently by phone/email but he never replied.
