Fake Encounter: UP Records Highest With 42 Cases

In a written reply to the Lok Sabha, Minister of State for Home Jitendra Singh said that of the total number of 194 fake encounter cases registered in 2011-12, UP recorded 42, the highest number of alleged staged shootouts.

He also added that UP was followed by Jharkhand with 20 cases of staged shootouts and Assam with 18.

Since 2009, the National Human Rights Commission (NHRC) has registered 426 cases of staged shootouts.

In 2009-10, 30 cases were registered in Uttar Pradesh and the figure rose to 40 in 2010-11 and 42 in 2011-12. In Manipur, the figure dropped from 32 in 2009-10 to 12 in 2010-11 and to 6 in 2011-12. While Uttar Pradesh has seen an increase in the number of cases, Manipur has witnessed a drastic drop, said a statement by the Home Ministry.

"Against 426 cases, 84 have been solved and the remaining 342 are unsolved. For expediting the unsolved cases, concerted efforts are made by NHRC for obtaining the inquest reports, post-mortem report etc. from the concerned state government," said Jitendra.

For the current year 2012-13, as on 17.4.12, no such case has been registered.

The minister said that as per the Seventh Schedule of the Constitution of India, "Police" and "Public Order" are State Subjects. It is for the State Governments to take action in every crime. The Central Government issues advisories, while the National Human Rights Commission (NHRC) issues guidelines and recommendations to be followed by the States/UTs in all cases of deaths in the course of police action.

Earlier, based on an application filed by Gujarat government the Supreme Court on Friday (date 13) sent notices to central and all state government to deal with all cases of fake encounter in the country.

Custody death: Life term, fine for 6 cops in Jaunpur

JAUNPUR (UP): A local court on Monday awarded life imprisionment to seven persons including six policemen in a 10-year-old custodial death case.

District and Sessions judge V K Pandey awarded the life sentence to one sub-inspector R P Tyagi, constables Ramesh Yadav, Mritunjay Rai and Gorakhnath and home guards Ashok Singh, Vijay Shankar Tiwari and one Hari Narain.

They were convicted of killing one Munnu in police custody on September 14, 2002 to favour Hari Narain with whom he had a dispute.

A case of murder was registered against them at Sujan Ganj area.

The court also imposed a fine of Rs 10,000 on each of the accused.

A case of murder was registered against the station officer and four other policemen for allegedly torturing a man in custody at Kheri police station in Lakhimpur Kheri district on Monday. The policemen have been placed under suspension.

Lucknow zone IG Subhash Chandra said that they were waiting for the post-mortem report to know the exact cause of death.

Lakhimpur Kheri SP Rajendra Singh said that the police had admitted Bhagwani (51) at the district hospital when his condition deteriorated at the police station on Monday morning. The records at the emergency section of the hospital showed that the police said the man was suffering from dehydration, he said.

He added that Kheri police station SO Shivajeet Singh had arrested Bhagwani and his son Lalji following complaint of a fight with his brother Sitaram at Loniyanpurwa village on Sunday night. Bhagwani’s condition deteriorated on Monday morning inside the police lock-up and he was rushed to the hospital. He died during treatment after an hour.

His son Lalji, who was in the same lock-up, lodged a complaint alleging that the SO and four other policemen had tortured his father, causing him serious injuries. He fell unconscious and died at the hospital, he alleged.

The SP said that a case of murder and illegal detention has been registered against the SO and other policemen and they will be arrested if the post-mortem report confirmed ante-mortem injury as the cause of Bhagwani’s death.
