Flaw in Fullmoon’s post-mortem

Shillong: There is nothing right about the manner in which late Fullmoon Dhar's post mortem was carried out. There was no X-Ray report and no videography to establish the veracity of police claims that the undertrial prisoner was killed in an encounter.

Deposing before the Justice retired D Biswas Commission, Dr M Pde, the Sub-Divisional Medical Health Officer (SDMHO), who executed the post mortem on the dead body of the undertrial prisoner Fullmoon Dhar, said the report of the X-Ray conducted prior to the post mortem was not available since there was no radiologist in Jowai Civil Hospital.

In absence of the X-Ray report it was not possible to exactly state how many bullets are still lodged inside Fullmoon's body. According to Dr Pde's deposition, there is only one exit wound and 11 entry wounds. In absence of a ballistic expert it is difficult for the Commission to get an accurate idea of the nature of the encounter.

According to Dr Pde, it is possible that more bullets could be lodged inside the body crevices of Fullmoon Dhar. Dr Pde informed the Commission that he had extracted three bullets from Fullmoon's body -- two from the chest and one from the abdominal cavity.

Fullmoon Dhar masterminded the Shillong jailbreak.

Dr Pde also stated that judging by the bullet wounds on Fullmoon's body, it appeared that he was shot from close range.

Interestingly, the statements of HS Diebgdoh, former Extra Assistant Commissioner (EAC), who is now BDO Ranikor before the Commission were contradictory to that of Dr Pde. In his inquest report Diengdoh had said that four bullets pierced the body of Fullmoon.

Civil Surgeon EF Gatphoh said before the Commission that no videography was taken during the post mortem of Fullmoon.

Talking to reporters after the hearing on Saturday,Justice Biswas who is heading the Commission said that two more witnesses from SCAMOD would be examined on Sunday.

On Saturday, the Commission also examined the officials of BSNL and Aircel in connection with incoming and outgoing calls from the two mobile phones of Fullmoon Dhar before he was eliminated.

It may be reminded that Fullmoon Dhar who masterminded the jailbreak on May 31 last year fled from prison with six other under trial prisoners. He was shot in an encounter in the forests of Jaintia hills on June 1.

Meanwhile the Inquiry Commission has got a further extension of 90 days and is expected to give its report to the Government by May 31, 2010.

The following case is interesting to understand as it shows some of the ways one can distinguish between a 'fake encounter' and 'proper encounter'.  Ironically, even as one says this, the ground situation in the north east blurs the difference between the two terms. It would not be wrong to say that anyone carrying a large sum of money is likely to be killed in an 'encounter' at any time, any where. Examples are in abundance in Manipur. Now there is an example from Meghalaya as well. Fullmoon, one of the master minds behind the Shillong, Central Jail break of May 31, 2009 was killed in an 'encounter' on June 1, 2009. He was supposedly carrying Rs. 2.5 lakhs in cash. Some reports say that ' It has been alleged that Congress District Council member from Jaintia Hills, Thomas Nongtdu funded the jailbreak. It has also been alleged that Union Minister of State for Water Resources, Vincent H Pala was in constant touch with Fullmoon on the phone before the jailbreak. Both, however, deny the accusations.' An inquiry commission has been appointed to investigate the incident.  The two news stories below expose the murky nature of the incident. 

 
Jailbreak mastermind had fled with Rs 2.5 lakh in cash

 SHILLONG, Feb 15 – Mastermind of the Shillong jail break, Fullmoon Dhar had Rs 2.5 lakh on himself before police tracked and shot him down near Um-Pawai forest in Jaintia Hills district, on June 1 last year.

Fullmoon along with six others escaped the district jail on May 31 last year. Fullmoon smuggled in arms, alcohol and money into the jail before the escape with the connivance of jail staffers.

One of the seven UTPs, Sankyntiewlang Decruse, who escaped the jail, deposing before a commission headed by retired Gauhati High Court judge, Justice D Biswas said on Saturday that Fullmoon had Rs 2.5 lakh in wads of Rs 1,000 denomination during the escape.

Fullmoon after the escape bought food with the money from villagers as the fugitives sneaked through forests to reach Jaintia Hills district in the next 24 hours, Decruse told the commission.

It has been alleged that Congress District Council member from Jaintia Hills, Thomas Nongtdu funded the jailbreak. It has also been accused that Union Minister of State for Water Resources, Vincent H Pala was in constant touch with Fullmoon on the phone before the jailbreak. Both, however, denied the accusations.

In another revelation, Decruse said that Warder Bharat Singh asked the escaping under trial prisoners to inflict injury on him to avoid suspicion from higher authorities.

Singh who was the guard at the jail gate on May 31, asked Fullmoon to injure him, while they were fleeing. Singh, according to Decruse, helped their escape, and Fullmoon before escaping hit Singh on the head with the butt of his pistol injuring the guard.

Singh later told jail authorities that he opposed the prisoners’ escape but his resistance proved futile. However, Singh and several other jail staff were suspended after their involvement in the jailbreak was established by the jail authorities.

The Biswas Commission has listed March 13 as the next date for hearing.
