No decision was reached by Chaffee County Commissioners Tuesday
regarding a Pueblo West request for waiver of 1041 land use regulations
in connection with four proposed waterwork structures in the county.

Proposed structures include an infiltration basin on the Frantz Ditch
near U.S. 285 and three water level and/or flow measurement systems.

The measurement systems would be installed on Gas Creek Ditch, at
Willowdale Ditch headgate on Chalk Creek and on the Pioneer Ditch in
Mesa Antero subdivision.

The structures are required to allow Pueblo West to use water rights
from the Hill Ranch. Pueblo West bought the rights in 2001 from Western
Water Rights, LLP who acquired them from Hill Ranch owners in 1986.

Commissioners directed Chaffee County personnel to review 1041
regulations to determine applicable requirements. They also discussed
need to ascertain Pueblo West plans for applying irrigation water to
ensure adequate revegetation of the dried up Hill Ranch in the county.

Officials indicated the question of a 1041 waiver will be discussed in
the future.

In other business, commissioners:

. Extended the moratorium on permit applications for geothermal
activities until Dec. 31.

. Approved the Pine Bough minor subdivision request to split 15.34 acres
into three lots with minimum lot sizes larger than three acres within a
rural zone on CR 193.

. Approved a plat amendment for Pamela Bentley and Michael Scavarda for
property on CR 197A, Nathrop.
