Hi, I am making a browser game and charging players to play my game.
Am I allowed to use APE without releasing my game under the GPL
license?

To clarify: the game will be browser based. Similar to the browser
based MMO demo on APE's website.

Does this count as "distributing" APE? Or am I charging for providing
a service and hence not distributing APE?

# Sorry, I am relatively new to software development. :)

APE is licensed under the GPL?

If you are not re-distributing this software, i believe you don't have to publish your source code. If you are not sure you should contact an attorney.

I am new to software development and licenses but I think APE is
licensed under GNU GPL from what I gathered here: http://www.ape-project.org/gpl.html

Consider what i said and check this thread for insights http://stackoverflow.com/questions/379510/is-this-legal-gpl-software-licensing-issues

Thanks for the reply.

I read that this is similar to running commercial services (like
Google) on servers using the Linux Kernel: since Google is not
distributing it, they don't have to publish source codes to all their
proprietary software.

Well, I am not selling or distributing the game. I am hosting it on my
webserver, and charging players to play the game via my website.

Players do not download or install any software, just log in and play
the game through the browser. I want to use APE to make the game "real
time" like the MMO demo on APE's website.

Correct,

Since you will offer a service using a GPL software and not sell it to the users, i think you should be good as long as you don't distribute this software of yours.
