Ok, so I was asked to post a lil regarding the licencing for the UK
(if you choose to ahve the server there)

I know of this because I'm working on settnig up my own station in the
UK

Scope is an issue here, depending on what band/etc etc we go under -
which will really depend on how many listeners we get.

2 Types of Licence
---

In the UK, there are 2 types of licence needed.First of all is PPL [1]
which pays royalties to the Performer of the piece, second of all is
the MCPS/MPS [2] Which pays the royalties to the composer/publisher

For example, if you were to broadcast the Jimi Hendrix recording of
the Bob Dylan song All Along the watchtower, then the respective
Webcasting licences would relate to the following rights:

PPL: This licence would be on behalf of the UK record
company that
controls the rights to the Jimi Hendrix
recording of the song.

MCPS/PRS: This licence would be on behalf of the UK
publisher that
controls the rights to the Bob Dylan song.

Even if the writer and artist are one and the same, the rights
contained within the
song itself and the recording of the song remain separate, so you will
still require
each type of licence.


PPL Places the following restrictions towards radio formatting.

(a) Distinct programmes or pre-programmed content (such as sound
recordings
being provided by a playout server) cannot be repeated or 'looped'
within a 3
hour time period.
(b) No advance information shall be given (either via the website or
announced
through the service) as to the specific songs that will be played
in the future.
Non-specific details of artists being played in the future can be
provided as
well as general information on playlists.
(c) No 'shuffle' function allowing random playback of music may be
offered.
(d) In any given 3 hour period of Webcasting there shall be:
(i) No more than 3 songs from a particular album
(ii) No more than 2 songs from a particular album consecutively
(iii) No more than 4 songs by one particular artist
(iv) No more than 3 songs by one particular artist
consecutively
(e) No unauthorised recordings (inc. bootlegs) shall be knowingly
transmitted.
(f) The licensee may not edit, re-mix or change any Sound Recordings.

PPL Does NOT cover

(a) Interactive services such as those where users can rate tracks or
artists to
influence the frequency or order in which they are performed.
(b) Services that allow users to skip, pause or move forwards /
backwards during
a programme.
(c) Transmission of the Service on closed networks or to mobile phone
networks.
(d) Services offering Archive Programmes that the user may playback on
demand.
(e) Services that offer the download of programmes or files containing
any part of
any Sound Recordings. This includes Podcasting.
(f) The use of Sound Recordings in Services to advertise or endorse
products.
(g) The transmission of Sound Recordings edited or synched to visuals.
(h) The public performance of Sound Recordings in bars, clubs, shops
etc.

In the following section, I wuill be referring to "streams" which are
recordings of any track played to a listener, so if you play 10 tracks
in one hour, and have 4 listeners listening for that whole hour, (and
only those during the hour) you have 4x10 "streams" = 40 "streams"

Fees
---

MCPS/PRS

Band A: £100 +VAT upto 165,000 streams per annum
Band B: £200 +VAT upto 330,000 streams per annum

At the moment, anything above this is having it's prices re-
structured, but a guide should be available at [3] soon

PPL:

Small Webcaster: £145.26 (broadcasting) + £21.79 (dubbing) = £245.26
Upto 270,000 streams per annum

B) Average Number of Tracks Streamed Per Hour

C) Average Royalty Rate per Streaming Hour A x B

D ) Estimated Streaming Hours Per Day

E) Estimated Streaming Royalties Per Day C x

F) Estimated Streaming Royalties Per Month E x 30

G) Estimated Streaming Royalties Per Year
