I-94......I-130....Lost.....Thank You

Hi, guys....thanks for reading even you won't respond. I'm kind of lost.
I got married 1 month ago and I know I have to fill out the I-130 form,
but thats all i know. Some people say I have to send G-325A and I-751.
There are so many things that can make me screw it up...with doctor and
fingerprins....im sure there is more. Basicilly I dont know anything I
guess. PLUS I DONT have an I-94 on me. There is just a stamp in passport
with date to enter US (1999 ). Is there some one who can help with
all this stuff, like step by step. What forms to send with I-130 and
what to do without I-94.......As i said before, THANKS for any responce
....... Jiri There is one more thing you might know about me...Visa
10 years since 1999...I remember I-94 for 90 days, got married to USC a
month ago, never left US. Do I need lawyer .....

You can get information about your I-94 you will have to fill out the
form i-102. I had to file all my forms together an wasnt able to file
till I recieved the information back about my i-94. It takes a little
while to get back but best to have it as they may not process your
application until then. What type of Visa did you arrive on. Are you
filing for adjustment of status?

I agree with Ian. Have at least a consultation with a lawyer to set you
in the right direction. You might want to hire the lawyer to continue
with you, since it seems you might have a loooooong overstay involved.

The place to learn about your immigration is at www.uscis.gov, but I'm
not sure you will be able to navigate around in there enough to find
exactly what you need. It's a lot easier to hire a lawyer to help you.

Yes you do need a lawyer.

However, you may prefer to file the I-485 right now in order to regain
legal status ASAP (rather than waiting to have the I-94 back).

In any case, a discussion with a lawyer is definitely a good thing.

Hi:

On one of the ATTORNEY chat groups, a very fine lawyer asked today about
the need for an I-102. Everyone noted the past practice that neither
LOS nor CSC required the I-102. However, there didn't seem to be
knowledge about what Chicago-Lock-Box wants.

I personally had to get my records from the I-94 before I could file my
paperwork for the I-485. This was as recent as Feb this year. I sent
my paperwork to the Chicago Lockbag

btw the I-485 does have ?'s that require info of the I-94 so I think it
would be safer to put the information then leave it blank

Hi:

Could you please describe what happened? It has been common practice to
file I-485's without the I-94 when it has been lost. The question has
been whether or not it was necessary to CONCURRENTLY file an I-102.
However, the way you word your response suggests thats that you could
not even file the I-485 at all without having first obtained the
information from the I-94.

Clarificattion would be appreciated.

MRF you are correct I couldnt file my I-485 without having obtained the
information off the I-94. I had been previously told that I didnt have
to file the I-102 an submitt everything together but since I had been
given so many different answers I wanted to make sure before I filed so
when I was getting ready to file my paperwork for the I-485 I called
AGAIN to make sure I had all the forms together an the correct
information an explained that I didnt have my I-94 # which is part of
Part 1 on the main page when u start to fill it out on the I-485.
Aswell my husband had to fill out the I-130 form an on the 1st page for
the Information about your relative on question 14 it ask If your
relative is currently in the US, complete the following: He or She
arrived as a (visitor, student, stowaway, without inspection etc)
directly below you are required to file in the Arrival/Departure
Record(I-94) an the Date arrived and Date Authorized stay expired, or
will expire as shown on form I-94 or I-95. I was instructed not to
leave any of the spaces blank on the forms unless it was not applicable
to myself or husband but obviously that was applicable to myself. So
when asked what can I do as I was told previously just submit it all
papers together they said you NO LONGER can do this, we used to allow
that but we made rule changes an that is one of the rule changes and
most people are unaware of this change. You have to have ALL
information from the I-94 or your form will be rejected. I was very
disappointed as the form is like $155 to file but now $160. Thank
goodness I didnt get hit with the increase. I really do feel like is
another way for the US Government to get more money from people...like
they dont get enough with all your forms an medical an biometrics an so
forth. I also had contacted an attorney in my area just to verify that
I was given the correct information an he said yes I was....still
uneasy I made an infopass appointment at my local office an they said
YES you need the information or your form will be rejected....So after
several people telling me that I needed it we opted to pay out the
money to play it safe....Ironically we submitted it was placed on hold
till I submitted further evidence...when calling them to ask them what
they wanted they refused to tell me...so I basically sat down an wrote
out a small but simple life story step by step in kindgarten english an
copies of all relevant documents showing my name changes from the time
I was born to a marriage then divorce an then a remarriage. I did
eventually get it back a couple months later approved an with all the
information I needed on it for the forms. Glad I paid out the money so
I would have the information an less chance of the forms being rejected
now that I could file them..Oh 1 more thing...u dont have to pay the
fee if it is USCIS fault that the I-94 is lost...wouldnt u guess
it...that after getting it back an approved I had remembered that when
I 1st applied for my 1st gc about 5yrs ago through my 1st husband they
took it an didnt remember this till after the fact but none the less I
had the information so I didnt care just a little disppointed that I
could have saved us some money especially since we are raising a family
of 4 plus my son having to pay child support an airline tickets for my
son through my 1st marriage. It is pretty sad that they charge you a
ridiculos amount of money for someone to jump on the computer an get
the information in less then a minute.

Please, Kat, can I ask a favour: do please break your posts into
paragraph as it is extremely difficult to read such a long chunk of

Now then: WHO actually told you all this information about the need for
the I-94? It wouldn't be the misinformation line, would it?

WHO is an immigration attorney and my local USCIS...aswell as an
Immigration officer. Sorry for the long blog but I just was typing
away an forgot to break it up when I was done. If you note that on my
post I did state that on the forms I-485 an I-130 you need to fill out
information about the I-94 on both of these forms.

Part 1 on the main page when u start to fill it out on the I-485.
I-130 form an on the 1st page for the Information about your relative
on question 14 it ask If your relative is currently in the US, complete
the following: He or She arrived as a (visitor, student, stowaway,
