Win7 upgrade program

Has anyone been promised a free Win7 upgrade with the purchase of a
computer that came with Vista?
I bought a new HP with Vista in July and after submitting all
paperwork and POP (proof of purchase) to the company that is
distributing the Win7 upgrade I was advised by the company, Arvato
Digital Services that they were not able to validate the POP that I
had submitted. I went to Fry's where I bought the HP and they assured
me that I qualified and the sales receipt from them was good enough.
The window of purchase dates is anytime after June 28th till Dec. 31.
Now it looks like Arvato is reneging on the offer. I don't know where
else to go. Fry's says there is nothing they can do. And I doubt if
MS will help in getting me my update. I had bought the HP because not
only did I get a good price but the promise of the Win7 upgrade.
Now it looks like I'll have to purchase it.
Anyone with this experience?

demand your software.

Finally called Arvato and the gal said, "oh, we changed our fax
number, so that's why we haven't received your latest copy of the POP"
So round three tomorrow as I head back to Fry's and get them to fax
the POP to the new fax number. Hopefully that will get me my Win7. If
I still experience problems I will then contact HP.

In America this would be considered a contract so he could sue under
contract law.

Quite correct. It's called specific performance. There was an offer,
consideration and acceptance. Avarto's failure to perform as agreed is
a breach of the contract. The suit would be small claims, defendant's
failure to appear would lead to default judgment which would allow
plaintiff to collect the value of the offer plus court costs. Good
Luck.

Chances are, Avarto is out of stock or something and is merely
stalling delivery or there was some cosmetic flaw with the PoP or the
forms submitted.

Another thing they do is refuse the first presentation, hoping you
will give up and go away. They keep the funds from the OEM and they
don't have to provide anything, easy money. Find out how to appeal the
process and do so.

Another possibility is with the present cash flow problems in this
economy Avarto DS has not received payment from HP or Fry's for the
fulfillment of the Win7 upgrade and is stalling until they have funds.

In any case, file an appeal, then make noise with HP and Fry's not by
phone, write letters. If it's not written down, it didn't happen.
