Only a matter of time: Outpost Daria has been Foxed

This afternoon, I received an e-mail from Yahoo! Website Services
(formerly SimpleNet) stating that my Web account has been suspended,
and that I have 72 hours to bring it into compliance with Yahoo!'s TOS
or it will be cancelled. The reason? "Intellectual property
infringement," with the name and number of MTV's legal counsel.

I guess it was only a matter of time, eh? I'm going to try to get in
touch with MTV's counsel this evening to see exactly what's going on.
If I can do anything to keep OD up, I'll do it. Otherwise, you should
consider OD to be the latest casualty of corporate greed and
short-sightedness.

(Note that this will not affect my continued enjoyment of "Daria," nor
will it diminish my involvement in fandom. However, it most likely
*will* leave a sour taste in my mouth that will take a long, long time
to go away. Certainly, I'm never again going to stick my neck out to
this extent for something that I enjoy, not if it means getting my
head chopped off.)

Well, good luck in the fight and as I said at the PPMB - This
royaly sucks!

MTV, way to repay someone who has given you oodles of free
advertising. Not to mention someone who brought a large part of
the fan community together. It's really a shame...

Fucking hell.

If Outpost Daria is taken down, what the hell does that say about all
the other fan sites out there?

Argh. God, I'm so freaking MAD.

FWIW Martin, I totally appreciate and enjoyed your work at OD, and I'm
sure we all will remember your enormous contribution to Daria fandom.

This is a dark day in Daria history.

Damn you MTV. DAMN YOU.

Hell! I was under the impression from the last round of this
(as perhaps where most people here). That provided you kept
with certain boundaries, ie no full episode movies, they would
cut a bit of slack.

This smells awfully like a new pointy haired boss has been appointed
and has deciding to throw his weight around.

I'm sorry. Well, from what I've seen of Simpson fan sites, after FOX attacks,
the results are not pretty. Too often the owners don't want to get involved in
the legal mess and immediately close their site. Either that, or they take down
all their pictures and sounds; there's some fine line where the lawyers decide
whether things like episode transcripts and fanfiction are legal vs. pictures
or sound content.

Well, I'm not you, but, please, please keep as much of O.D. up as you can. Of
course it's up to you, but the archive of MQDRR's, transcripts, song lists, and
fan fiction (stuff which Viacom/MTV shouldn't be able to take away) are really
invaluable. I know alot of other people feel the same way, and I'd be sad to
see your site go. If it does, though, let me say thanks; and in the words of
Homer Simpson, "It was a great ride while it lasted, kids. Let's go home."

I'm far from a legal expert(Rich?) but seemingly the only things that can be
seen as violations from my POV would be the graphics used, and possibly the
transcripts. If taking those out doesn't help, try moving to another ISP
which isn't so stringent, or a combo of both.

Secondly, I've had OD bookmarked since I got online in Oct. '98, when it was
in it's infancy, and since thn has been my #1 source for all Daria related
stuff. If it has to go,then so be it. I'd just like to say Thank You for all
the work you put in over the last 20 months or so in keeping OD up and
running, I and a great many others appreciated it.

Lastly to MTV, Viacom, or Yahoo, whoever is mainly responsible for this:
<lifts hands away from keyboard to give the responsible party/parties two
great big extended middle fingers> WAY TO THANK THE MAN FOR FREE ADVERTISING
OF YOUR MOST HIGHLY RATED SHOWS!!!!!

As I've said in another thread, this saddens me greatly.

People paying a return visit to The Irony Maiden will notice that, in
response to the Foxing of Outpost Daria, I've amplified the legal notices,
and removed 2 pictures and 1 graphic element which were derived from the
show. It does make my site less attractive, but I'm *not* simply going to
pull it down when I can save it in some form by eschewing any material which
might lead to a claim of an infringement of intellectual property rights. If
MTV's various departments get together and produce a "fair use" policy for
webmasters which promises freedom from harassment for those who abide by it,
I'll put the pictures and graphics back; but unless that happpens, one of
the effects of the action taken against OD is that my little Daria site is a
less effective free publicity and support vehicle for them.

I've left the link to Outpost Daria, in the hopes that it returns.

A page on The Irony Maiden explains the action I've taken.

Well, this sucks, but it's not surprising, considering the parties
involved-- Yahoo and MTV's legal dept. Way to kill the golden goose.
Morons. All I know is that OD is an infinitely better site than any
other Daria site that MTV has ever put up, mostly because it's a
community site, not a push site-- the fans contribute the content,
rather than having it jammed down our throats by people who think they
know us better than we know ourselves. And I don't even want to talk
about MTV's MB/Chat Room. Yecch. Sorry, but I can't even fake being
*that* stupid without a good sharp blow to the head.

I can't help but be reminded of the Japanese saying, "The nail that
sticks up gets hammered down."

Well, that's about all I care to say about this until we hear more.
Now you know why I left the law-- I'm a lawyer, and I hate these guys,
too. Imagine havintg to deal with these kinds of people all day. Ugh.
That's a fate worse than death by something really painful and slow.

Oh, lord. I never thought MTV would have gone this low. Where were my
senses? As everyone else has said,(Well, in one way or another) there
goes *the best* free advertising site MTV has ever, and probably *will*
ever have.
