A 41-year-old woman was drunk and vulnerable when she had sex with a
14-year-old boy during a drinking binge, a court has heard.
Jenny Lee Mitchell had sex with a 17-year-old male then his 14-year-old
friend after they spent a night out drinking, the Victorian County Court
heard.
Mitchell told police she had 18 cans of Vodka Smirnoff alcopop during
the binge, was very drunk and had no memory of what happened, prosecutor
Kevin Doyle said.
The court heard the two males were seen high-fiving each other when they
were at the police station for questioning after the incident.
Mitchell, of Sebastopol in Ballarat, has pleaded guilty to one count of
sexually penetrating a child under 16 over the incident, which occurred
at her flat between February and March last year.
Defence lawyer Tim Marsh said his client began drinking excessively
after she was weaned off pain medication for an injury.
Mr Marsh said she had a tragic personal history marred by abuse and
neglect and this was her first time before the court.
He said his client became very vulnerable when drunk and her behaviour
was out of character.
He said she was ashamed and regretted the acts, which were consensual.
Mr Marsh said there was "no apparent harm" caused to the victim.
"The complainant's victim statement tends to be more about shame and
regret than trauma," he said.
During the pre-sentence hearing, the crown submitted that a suspended
jail term is within the range of an appropriate penalty.
The maximum penalty for the offence of sexually penetrating a child
under 16 is 10 years jail.
Judge Howard Mason will sentence Mitchell next month.

Augh! By age 41 she knows she can't control her behavior such that she
stays within the bounds of the law when using alcohol. As an adult that
means one choses NOT to use alcohol, of you you do, not in a way that
will end up in illegal behavior. She's therefore fully responsible for
putting herself in a situation where she'll act
inappropriately/illegally, and she should be held fully accountable.
My only sympathetic comment here would be, she was using alcohol after
being weaned off pain meds. I wonder if she was in severe pain and
unable to get the meds she needed due to DEA or something. I'm not
excusing her, just acknowledging one reason she may have used alcohol
regardless.

I'm going to come off in a really different dirrection here and attack
another gender stereotype.
The stereotype I'll attack is this: "Girls are more mature than
boys."
There are some ways that this is typically true. On the other hand,
boys are generally mature enough (and have good enough social
skills!) to have consensual sex when they are "underage" with out it
having a particularly damaging effect.
There was a study in Holland? Belgium? About this that was roundly
criticized by people concerned that even asking people about their
history is exploitive when the history involveds sex ewhen they were
young. If I get the time and motivation, I might search down teh cite
if anyone is interested (There are hazards to using internet search
engines to try to find scientific studies on this subject ).
They found that boys were not damaged (self-evaluation years later) by
early consensual sexual activity, but girls were.
So it is unfair to typically punish women less for this crime than you
would a man, individual examinationi of the cases and the likely
damage teh crime did might justify it.
Now in both boys and girls, there is clearly some damage done to the
"victim" by the legal process of punishing the "perp." Very few
people would like to see a lover they chose (even with an immature
facility of choice) get such a severe punishment as is typically
meted out.
Very little science has been done on evaluating this damage.
That being said, Michael is dead-on about the headline. If the
genders were reversed it would say something to the effect of "Man who
raped teens was drunk."
You would never see "lonely, vulnerable male teacher seduced by
'stunning' high school girl." Does that happen, though? I'm
guessing.

Umm...what? The woman was basically passed out. The 17 year old passed her
off to his younger friend.
