Police Hope New Information Could Crack 3-Year-Old Murder Case

WILMINGTON, N.C. -- Ann Miller has a new hairstyle, a new house and a new
husband. But something old still is hanging over her head, the unsolved
murder of her first husband, Eric Miller.


The University of North Carolina at Chapel Hill AIDS researcher died from
arsenic poisoning in December 2000. The case remains open -- still active.


"There's no statute of limitations on murder in North Carolina," District
Attorney Colon Willoughby said.

Raleigh police have not named Ann Miller a suspect. But the focus of their
investigation and the public's attention has been on her.

"Anybody who had access to him would have to be a suspect," Raleigh police
Lt. Chris Morgan said.

Investigators believe Ann Miller was having an affair with co-worker Derril
Willard at the time her husband died.

Willard committed suicide after police questioned him and searched his home.
Before Willard died, he talked to defense attorney Rick Gammon.

The state wants Gammon to reveal what Willard told him. The North Carolina
Supreme Court is expected to rule on that question soon.

"If I'm ordered to do that, and that's the final word, then I'm going to
comply with whatever the Supreme Court tells me to do," Gammon said.

Said Willoughby: "We're anxious to get the information and, hopefully, solve
this case."

Ann Miller has refused to speak to police since her husband was killed. But
her new life goes on in a quiet Wilmington neighborhood.

Real estate records show that Ann Miller has owned her home in Wilmington
for more than a year. Neighbors said her new husband and she often are out
in the yard grilling, gardening, and playing with her 4-year-old daughter.

But neighbors also said the couple keeps a low profile, rarely speaking to
anyone.

When WRAL tried to speak with Ann Miller last week at the pharmaceutical
company where she works, she had nothing to say.

A few months ago, she went to the register of deeds in Pender County to get
a marriage license with her boyfriend. She married Paul Kontz, a guitarist
and singer in a Christian rock band, at the North Wilmington Community
Church in November.

Kontz did not want to talk to us, either, and tried to avoid our camera.

As Ann Miller steps back into married life, police watch with interest,
still trying to figure out who killed her first husband.

"I feel confident that we will find the truth," Morgan said, "and at that
point, if there's an arrest to be made, it will be made."

The attorney who may know the truth soon could be compelled to talk.

I rather expected Ann Miller to look like Marilyn Monroe with all these men
buzzing around her. I was surprised to see she looks rather ordinary -
nice, but nothing spectacular. Her husband, the dead one, was a rather nice
looking guy, though. I wonder what the new husband and the dead lover looked
like?

Giselle (I wonder if she got the boyfriend to do it and now there's no one
to testify against her?)

It's funny, but the old boyfriend has never had a current picture. The only
pictures I've ever seen of him look like yearbook photo's, perhaps college?
He looks pretty cute in the yearbook photo, but in a boyish kind of way.
Very young looking. Now his current wife was not very attractive looking,
IMHO. I'd seen her a couple times on the local news. If she's who I think
she is, she was rather overweight, which tends to age a person. She looked
much older than the mothers of year old babies, which she was at the time.
She was the one who found her husbands body after he commit suicide. I
can't recall, but I want to say he hung himself. I don't think it was a
shooting, I believe he hung himself in their garage. She came home from
work that day with her child in the car with her. The garage door opened,
and she found him hanging there in front of her. I remember it was on the
news immediately, because her house was still hounded by reporters looking
for a comment/story. So when that automatic garage door opener flipped the
door up, the news people were right there to see it, and it was just in time
for the local evening news in the 5:00 to 6:00 hours. Very sad for this
woman.

Don't know what the new husband looks like. They caught a shot of him on
the late news last night, but he was in his car, driving away from the home
he shares with her in Wilmington, N.C.

As to getting the boyfriend to do it, the first time Miller was hospitalized
was after having been out bowling with Willard and a couple other men.
Willard provided Miller with a beer that night, and shortly afterwards,
Miller became violently ill. Miller was in the hospital for quite awhile
after that instance, perhaps a week or so? He was discharged after
improving, without the doctors knowing what made him ill. He went home, and
Ann Miller fixed him a 'big meal' where upon he became violenting ill once
again, and was hospitalized. This second hospitalzation he didn't recover
from. He died before they knew it was arsenic poisoning. And after he
died, testing was done that proved he'd been systematically poisoned over
the previous six months or so with smaller doses of arsenic.

Well she's certainly got prior experience at 'making a man go away'.
Personally, I hope they can get this bitch. From all accounts Eric Miller
was a really nice man, came from a middle-America type farm family I
believe. His parents and whole family all appeared to be quite nice, soft
spoken people, who've had a really hard time trying to see their
granddaughter since their son was killed. I've never heard them speak a
negative word about Ann Miller, as their main concern was being able to keep
a relationship with their son's child. They either live in Iowa or Ohio,
can't recall which right now, but they visit Raleigh once or twice a year to
try and see their grandchild. Everyone here really 'feels for' them. Ann
Miller, on the other hand, has always come off as a cold-hearted bitch. I
believe she's hired Joseph Cheschire (sp?), as her attorney. He's the most
liberal, rights of the accused, type attorney's practicing in our area.
Here anyway, he was much more high profile than David Rudolph prior to the
Rae Carruth case. I don't think I"d ever heard of Rudolph prior to Carruth.
But Joe Cheshire has a reputation somewhat like Fieger. He takes lots of
death penalty cases and IMO, tries very hard to get scum off.

treated for poisoning.

Eric Miller was released from the hospital.

Eric Miller was admitted to the hospital again.
Dec. 2, 2000
Eric Miller died from arsenic poisoning.
Dec. 4, 2000
Ann Miller's lab at GlaxoSmithKline was searched by authorities. Authorities
found a toxic arsenic compound there.
Jan. 21, 2001
Authorities searched Derril Willard's home.
Jan. 22, 2001
Derril Willard commited suicide.
