Text of Kobe Bryant's statement read in court by his attorney, Pamela
Mackey:

``I want to apologize to her for my behavior that night and for the
consequences she has suffered in the past year. Although this year has been
incredibly difficult for me personally, I can only imagine the pain she has
had to endure. I also want to apologize to her parents and family members,
and to my family and friends and supporters, and to the citizens of Eagle,
Colo.

Although I truly believe this encounter between us was consensual, I
recognize now that she did not and does not view this incident the same way
I did. After months of reviewing discovery, listening to her attorney, and
even her testimony in person, I now understand how she feels that she did
not consent to this encounter.

I issue this statement today fully aware that while one part of this case
ends today, another remains. I understand that the civil case against me
will go forward. That part of this case will be decided by and between the
parties directly involved in the incident and will no longer be a financial
or emotional drain on the citizens of the state of Colorado.''

What evidence? Even the prosecution's own HIRED expert said their evidence
was weak. Meanwhile, the prosecution's own CBI is testifying for the
defense. Basically TWO experts from the prosecution switched sides.

He refused to plea to a lesser charge. However, a simple statement, written
by his lawyers was enough to get the case tossed.

case. And his statement says that he did NOT know the sex was NOT
consensual. He just said that he has now realized she didn't think it was

He maintained that he never formed the mens rea for the crime; he thought
she consented and then realized that she had not.
He confirmed her sincerity in the charge; thanked Jesus for getting the hell
out of there and looked forward to settling the civil case.

The civil case will be quietly settled with a large check for the
'misunderstanding', and Kobe will be $40M lighter, between the Defense, his

He can arrange his cover story with Jim Gray however he chooses. He's on
record with the public as respectfully acknowledging her integrity and
remorsefully acknowledging her suffering. Now that she's gotten his apology,
I'm certain she will be more than happy to allow him to pay up quietly.

Your hero is no martyr, and he is certainly no champion of virtue. Let's
just hope he never repeats this sort of behavior.

She has received both money for lost wages and money for services.
Colorado law stipulates that as a part of her getting that money she has
to co operate with the DA. She has not done so. What is the mechanism
to make her pay back the ~ $20,000 she has gotten?

PS: could someone again give the url to the victims funds? Specifically
what happens when victim takes funds but then refuses to co operate with
the state?

Why would he believe she's endured pain if he in fact doesn't believe he
raped her? Any pain would be of her own doing, and nothing he did.

That is why K's lawyers filed the lawsuit in Federal Court. Not to worry,
Laker's insurance will cover any settlement since Kobe was not convicted
of a crime. Look for a quick settlement by all parties involved.

What did he admit? Poor behavior. He sees it as consensual, he knows that

I didn't read any acknowledgment of her integrity. He validated her
feelings, maybe. Her integrity won't recover until she matches Kobe's

Either you didn't read the statement or you don't want to face what it
means. He's officially saying that her accusation was sincere and her
suffering real. Maybe he's not sincere (while he allowed the statement to be
made in his name, he wouldn't read it himself), but if so, that undermines
his integrity, not the woman's.

I think that is the case. He's nearly admitting guilt publicly now that
he is free from going to jail. Now he'll give her a nice chunk of
change and think he is absolved of his actions. Once again, money and

I agree that it was probably co-written by Clune and Kobe's attorneys.
Probably was written a couple months ago when the DA was offering to
drop the sexual assault charge for Kobe to plead guilty to a

I am disappointed a bit in Kobe for not going to trial. This case was
incredibly weak and with the latest DA misconduct all the microscopic
injury bullshit would have been disallowed in the trial leaving just
her testimony. But facing life in prison vs getting the case to go
away from an apology is a hard decision for anyone.

She will probably settle for the 20K she has to pay back Colorado.

The only thing the case proved is the Colorado rape laws need to be
heavily revised to require some sort of evidence besides the accusers
word. In California, we have the same feminist laws where no evidence
is required. The LA Times a couple months ago ran an article about
rape trials in California. In the vast majority of cases, the juries
are refusing to convict people unless there is evidence that a rape
occurred - just the victims word is not enough. All the new rape laws
have done is waste huge amounts of taxpayer money on cases that can't
be won.

That's in the nature of an Apology; accepting guilt.
That's why they had to keep it out of the civil suit (to protect him from
accepting the responsibility), and he had to admit her position.
The State screwed up so badly that she was in constant danger. No need for
her to sacrifice herself to their incompetence.

Appology does not equal confession, and refusal to pay
does not equal "weaseling". He basically said he's sorry
her feelings were hurt.

is that _he agrees to disagree_ over their different perceptions
of the event.

That's extremely easy for you to say when it isn't
your freedom in the hands of 12 people whom you've
never met. There are innocent people who plead
guilty to lesser crimes all the time, in order to
avoid risking the sentence associated with a
greater charge.

I posted this earlier -- it's from an attorney
acquaintence (posted with permission). Also it's
interesting to note that he wrote this about a month
ago, but a lot of what he wrote about is exactly what
happened:


Hate to say this, but as a defense attorney, I'd advise Kobe
to do this in a second. I'd prefer that the criminal charges
be dropped altogether (and while [the accusor] can't guarantee
that, she could more or less force it if she tells [Hurlbert]
she will *not* testify), but I'd even consider a plea if it
meant 1) probation only, and 2) not requiring sexual offender
registration (which of course is a pre-requisite to this
entire process).

Why? Well, there are a whole litany of reasons.

1) Certainty of outcome. Even though everything has come up
great for the defense so far, there is still a lot we don't
know about the case, like what [the prosecution's] experts
are going to say, how they will hold up under cross-exam by
Pam/Hal, and what precisely Kobe said to the police. We like
everything we have heard so far, but we are also Kobe
supporters, so we interpret all evidence in the light most
favorable to the defense. Head over to the CourtTV boards,
and you'll see that - unbelievably - there are still quite
a few people who think Kobe did it.

There is *always* a risk at trial, even with the best
lawyers in the country. If I can do anything to prevent it,
I'd try at all costs to keep 12 people from deciding
whether my client goes to jail. Yes, it's a compromise,
and yes, Kobe may regret doing it later on. But I guarantee
you that he won't feel as much regret as he would if he
didn't do the deal and somehow (unfathomable as it may seem
to us) was convicted. Now that would be regret.

2) Cost of defense. Rumors are that Kobe has spent more
than $3 million on his defense so far. I don't know how
valid those rumors are, but given the amount of paperwork
generated in this case, and the amount of investigation the
defense has apparently done, it wouldn't surprise me. If
this case goes to trial, that cost doubles, easily.

Now add in the cost of paying his lawyers to defend a civil
suit, and you can add several more million to that tab.

3) Cost certainty. Even assuming that Kobe prevails at
trial and is acquitted, he will still face a civil suit.
Clune has all but guaranteed that, and I've suspected all
along that a civil suit was [the accusor's] ultimate
endgame - it's the only thing explains why she would
perpetuate this lie this long. So, just because a jury
does not find Kobe guilty of rape beyond a reasonable
doubt, does not mean that another jury could not find
Kobe liable for tortious battery and intentional/
negligent infliction of emotional distress based on the
preponderance of the evidence and award [the accusor]
millions.

Remember, the rules of evidence and discovery are
markedly more relaxed in civil cases as compared to
criminal ones. Kobe cannnot avoid having his deposition
taken in a civil case, and cannot avoid testifying.
[The accusor's] character evidence is coming in, but so
will Kobe's. His name will continue to be in the news
for negative reasons not associated with his play on the
court. He will still be mostly off-limits for endorsers.
Plus, he will likely have to make even more appearances
in Colorado (though not necessarily for court) during
the season.

I represent large companies and corporations for a
living, and these are their main concerns, with the last
one being paramount. I've participated in more than my
share of unjustified settlements because the corporation
wanted to cap their risk and their cost, even if it meant
paying more than I felt the case was worth.

If Kobe can 1) avoid trial and any other negative
repercussions from the criminal case, 2) cut off his
rapidly escalating attorney's fees in the criminal case,
and 3) pay off [the accusor] for substantially less than
it would cost to pay his attorneys in the civil suit and
pay some sort of reasonable judgment to LLT, then I think
he has to strongly consider it.

As his attorney, I would advise him to, because that's
how these types of decisions are made. But if it were me,
and I were innocent, I don't know if I would be that
rational...

If there really was no impropriety, there'd be none to find. The case
was going to be dismissed because she wasn't going to testify. He
definently had the advantage. I believed that she was lying due to the
dna results that were leaked and a little personal knowledge. With his
apology for his "behavior that night" I go hmmm now. I believe Kobe
had the money to completely clear himself, the truth is worth more than
any amount of money.

Of course he was. I am sure they wrote it the aplogy (after consultation
with the accuser's attorneys), then told him to sign it. In a legal sense,
it's his statement, and the statement vouches for her integrity.

Do you honestly think his attorneys would have him sign it if it didn't
represent the best he could hope for? Why do YOU think his attorneys had him
apologize?
